I really want to buy a 5th Gen. iPod right now, but I am feeling that on Jan. 1st Apple will upgrade the 5th Gen. to 40GB and 80GB and my iPod would only be 'new' for about a month. Will Apple upgrade immediatly after December, or will all the Christmas people get a grace period to enjoy their new gift?

I personally don't think there will any significant changes to the 5G iPod. But as you said a GB increase may be possible (guess that is some what significant, huh?). I say, if you need an iPod now, then get one. But if you can wait till a bit after MacWorld in January, then do so to see if they increase the capacity.
 
I think there's little doubt that the next revision of the iPod will increase capacity to 40 and 80 GB. However I don't think it will be coming that soon. I wouldn't be surprised it if didn't come until April or possibly at WWDC around June.
