I thought lack of 3G in V1 was a software thing so shouldnt a sim from a 3G plan work in a hacked v1 iphone, considering someone could develop a software hack?

No. It's a hardware thing. End of discussion. The SIM will work for whatever plan it's on, just not at 3G speed.
