In the conditions for warranty or whatever it says there can be no physical damage. Well the button to turn the volume off has fallen off, not due to abuse, a day or two ago it just fell off and I couldn't find it.

But also my phone has to be charged 2 sometimes 3 times a day, it constantly freezes, wi-fi never works, never vibrates and I get the 'white screen of death' constantly.

My warranty isn't up until January, and I don't even want an upgraded 3GS, I just want a WORKING 3G. Do you think even though there is minor physical damage they would replace or at least fix my phone?

PS I have tried to restore it a few times. And I deleted and did not re add any apps I had thnking maybe twas a virus.
 
That sounds like alot of problems.
They would probably exchange your phone, or at least repair it.

If you are getting software issues then you should try to restore the phone in iTunes. They won't replace your phone if you haven't even tried to restore it once.
 
Take it in. I'ts under warranty. They'll get you a refurb easily. If they're in doubt, they can check the battery life on it.
