Hi,

Well I have a week 7 MBP 15.4-incher. I've got all the problems everyone else is experiencing. I have been holding off getting in touch with Apple because I thought they might have come up with a fix but it looks now as if they wont.

Now. Since the 17-incher is out and doesnt exhibit any of the problems associated with the 15.4, would Apple exchange it for a 17-incher. It seems pointless having another 15.4 if its going to have the same problems.

There is obviously something wrong with the 15.4 model if the 17-incher is perfect.

What you guys think?

I was thinking the same thing but I asked and my local store said no. Seems like Ebay would be the only choice and then buy a 17" I'd be sure before I did it that the 17 was not showing any of the mentioned problems.

Well. I would want a full refund from Apple for my 15.4 if they wont exchange for the 17-incher. I've read on the Apple forums that the 17-inch doesnt have any of the problems that the 15.4 does.

And in the UK a maxed out 15.4 is more expensive that the equivalent/better specced 17-incher.:confused:

My understanding is if its not within the 14 day window they won;t exchange it

The 14-day window covers software and hardware. There is a 1-year manufacturers guarantee which covers hardware. As the MBP's are experiencing manufacturing problems, Apple are legally entitled to offer refund or replacement under the Sale of Goods Act.

From the DTI website.

Sale of Goods Act

Under the Sale of Goods Act 1979 traders must sell goods that are as described and of satisfactory quality.

If consumers discover that products do not meet these requirements they can reject them and ask for their money back providing they do so within a reasonable period of time. Alternatively, they can request a repair or replacement or claim compensation.

The Sale of Goods Act has been amended by the Sale and Supply of Goods to Consumers Regulations 2002 which transpose a European Directive. Although the impact of the Regulations is relatively modest there are some useful benefits for consumers.

From what I've heard you have to go through 3 repairs before they'll replace the product. I don't think you'll be able to get a refund or exchange it for a different model though. Sucks when you're paying that much money for the hardware...

Well. I'm legally entitled to a full refund. I can put that towards the price of the 17-incher. Which actually works out cheaper then the same specced 15.4-incher.

Not to sound rude. But why ask if Apple will switch it and then argue with everyone who says that they won't? I doubt they will. Look how many issues iGary had before they stepped up. I am sure the 17" will have some problems too, they just came out. Give it a little time and the 17" owners will be screaming too...

You're only entitled to a refund (assuming it's after 14 days) if they've made multiple attempts to repair it and still can't get it right. I thought you hadn't had anything done with it yet?

You can certainly try getting a refund, but apple will likely try and fix it instead. If the 14 days are up you'll likely only get a refund (or even a replacement of the same model).

Go ahead and ask to return it since it's defective. If they don't go for that, keep sending it back until it's perfect (each time giving them the option to take it back for a refund to get you off their back). And there's always the BBB if necessary.

True though they do make exceptions. My 15.4 powebook had the line issue which apple wouldnt resolve no matter how many times I rang, but when I rang about the battery playing up they said they'd replace the powerbook completely. It was then at this stage I managed to get a swap.

Apple when replacing hardware basically are selling you a new machine and a new invoice is made up for it. I rang Apple asked them to exchange it for a new iMac Intel 20" and they told me to accept delivery of the new powerbook, dont open it, ring them back up and they'll collect it and refund me my money. They did that within 6 days...

It wasn't a swap parsey and Apple don't do straight swaps for other hardware but it was a handy way of changnig machine...

I called Apple and tried to do just that. Not gonna happen. You have to get a full refund, then re-order a 17mbp. Its a pita, cause it takes about 2 weeks. Have to wait till I get my refund to buy the 17 :( But the 17 is nice, bigger screen, better dvd drive, fw800, and right click!!

DID I hear (read) you correctly? Did you say the MBP 17" has "Right Click"? Why is this the first I'm hearing of it? I don't recall seeing that in any of the media's reviews/comparisons. Makes me want to sell my 15.4 on eBay too. Although, I like the size of the 15.4 and I wouldn't have a need for the ACD 30" if I get the 17" MBP. I can live with the heat and whining because mine isn't the severe or often and is easy to put up with for a year or two before I upgrade to the next release. All ownership in computerdom is temporary, isn't it?:D

They don't have any right click but a simulated software one.

Works great though. Tap two fingers on the keypad and it's a right click. Tap two fingers on a web page and you get a BACK button. It's awesome!

To the OP, are you in the UK or in the USA. Makes a big difference to your question. FWIW, Apple did exchange my MBP15 for a MBP17. It was scheduled to be replaced, they announced the MBP 17 and with one phone call they agreed to replace my MBP15 with a 17" instead. And heck, I got money BACK. :eek: :D

Mmm, yes. Just read about iGary's issues. I have awful luck with my macs too, but iGary's problems just make them seem not so big. At least his misery serves some beneficial purpose :).
