So I have this plan to return my current iPhone to the Apple store and say the battery doesn't work and get a refurbished iPhone and sell it on eBay. I'll be selling a brand new iPhone for a much higher price...
Am I likely to fail or not?

Well if you say the battery doesn't work, and they check...and it does... I think you will probably not succeed.

I don't understand... if you are getting a refurbished phone then how are you going to sell a brand new phone? Are you saying that you are going to try and pass off the refurbished phone as brand new??? If so then I say fail because those come in a generic white box

This too, Apple is not just going to replace your phone because you say something doesn't work. they have to be able to replicate the problem or see for themselves running a diagnostic.
 
Other than the illegal warranty fraud, and the product representation fraud of selling a refurb as new, sounds like a great idea!

This has FAIL written all over it. DO you think they just hand out new phones to any idiot who comes in and asks?

Yea, I'm planning on selling it on Craigslist and say its brand new since the refurb will have the plastic wrapped on it, I mean, a refurb is basically a BRAND NEW phone physically...

Yup, I'm planning on doing this, get a new (i say new because when they give you the refurb, it comes with the little pastic thing covering the iPhone) phone and sell it on Craigs or eBay :D

Not necessarily, I've been getting away with it, all I have to do is be as serious and persuasive as possible and the Apple guy will believe me. My brother is on his 3rd iPhone...

Not necessarily, I've been getting away with it, all I have to do is be as serious and persuasive as possible and the Apple guy will believe me. My brother is on his 3rd iPhone...

Those days are long gone when you can just say something is wrong and they will replace it. Apple has implemented new software that can display battery life, dropped calls %, time since last restore, etc, etc just by plugging the iphone into one of their diagnostic macs. Unless its a verifiable problem that can be reproduced, apple will not longer replace it.

No, a refurb is NOT a brand new phone. That's why refurbs are labeled as such and sold at a discount. It's fraud and people go to federal PMITA prisons for fraud.
 
And what about your contract with AT&T? They will charge you early termination fee, which would wipe out any profit.

Frauds like this make it more difficult for people with real issues to get help.
