Am I likely to succeed

Two things. How are you going to explain the serial number that begins with 5K, and how are you gonna explain that you have 2 months left on your warranty for this "brand new" phone.

It's one thing to try to rip off Apple, another to rip off your fellow consumers. Karma will bite you hard.

LA ftw, too bad most if not everybody in this city are dou**es, and the city itself is trash that has no value :) lol, but you still love it.

are kicking in here! sure ts they give new phones to anybody that says they have a bad battery. TS it helps if you wash the phone with Soap and water too. that way the phone is clean and the battery won't work, just like you said.
 
I don't think it's a huge issue if you:

1. Have a legit reason to return the phone. Look at your dock and by your headphone jack... there most likely will be a crack somewhere. I had one by my dock and one by my hp jack the second week I had my 3gs. This way you're not trying to rip off apple making you a douche!

2. List phone as a new refurb which it is. You will still get top dollar.... I listed all my previous refurbs as such and they still sold.

3. Grow up a bit and stop expecting to get something for nothing. Sure you may get away with it for a while but as tons of others have said, Karma is a beotch and it will find you some day.
