Thank you! I haven't altered (unlocked/jailbroken) or done any modifications to the phone. The Genius checked all that and she was shocked that she saw a RARE iphone 2g that is STILL under warranty! So I will be taking the phone with its original sim card in it AND the same number that I ported to T-mobile prepaid. Do you think it is going to be a case where they will reject my plea? The phone is almost useless and I don't want to be stuck with an ill-functioning iphone just because of a sim card.

just go in there tell the truth and tell us how it goes
 
If you dont have a contract, or bought a contract free phone what is the difference.

The phone has a warranty and the warranty is not contingent on active service.

I would call Apple corporate and work this out there. Get a contact name and phone and have that with you when you get to the store.

Either your phone is or is not under warranty...if its not and they are doing you a favor, then they certainly can stipulate the conditions.
 
A contract free phone can only be sold as long as it is going on an active iPhone plan. It just doesn't extend the contract, that's what a contract free iPhone is.

Well I actually have bought about 5 iPhones from BestBuy and never got a contract from AT&T and don't have an active service with them either.
 
My two cents... The AppleCare warranty is between you and Apple. The 2G wasn't a subsidized phone and so there shouldn't be any issue whatsoever (at least not legally). Regardless, I think if you bring in the T-Mobile SIM, it won't work to activate your replacement and they'll say "sorry, I don't know what to do here" because that particular has probably never dealt with this. Be super polite, tell them the situation, work with higher-ups at the store, etc. Eventually you'll have to get to a point where they'll either give you the phone without having it activated (more likely) or they'll actually unlock it, which is what they should do anyway (less likely).

The thing about this is that you should be able to have your phone unlocked now that you're out of contract. I don't know of anyone who's gotten their iPhone unlocked though but you do have a good opportunity here to insist on that. If you have the energy, I'd go for it! ;)

This is on Best Buy's website... "iPhone only available with new 2-year contract or eligible upgrade with AT&T".

Maybe because it's BestBuy.

If you buy a contract free iPhone at AT&T, they will only sell it to current customers. They have had that rule in effect since the 3G. I think Apple is the same way.
