So if Apple wins and gets a whole bunch of Android phones (not just the Galaxy Nexus) knocked off the market. Isn't that bad for them? Ya they have less competition but now they would have to worry about the angry mob of people.
 
let me start off by saying I am kinda getting interested in the whole court precedings. It's kind of exciting.

And no I really don't think there will be a huge angry mob either way. Although I don't know how much it will really benefit them, seems like it's more a pride thing. I think that regardless of what happens in this trial, and no matter what happens in the smartphone race over the next few years, the iPhone marketshare will remain steadily around in the 25-45%. And I think that's right where it should be.

Yeah I'm very conflicted because I want WP and BB both to do really well, because that will continue driving competition, and because they both seem to have a pretty good OS that deserves to do well.... but on the other hand I want all of the people I know to have iPhone's for iMessage and FaceTime purposes... :p

You don't seem to understand the trial here. They aren't trying to ban products, they want to prove the similarities so that they can claim that they are owed damages to loss of sales.

What "whole bunch of Android phones"? Apple took the one company to court that is slavishly copying their designs, and nobody else.

I read elsewhere they Apple was looking to get a few devices banned in the process. Which makes sense because it would be pointless for Apple to go to court over money.

I've mostly read stuff talking about tablet bans. Haven't really heard any talk about smartphone bans.

Why wouldn't Apple want to go to court to try to win billions (with a b) of dollars? Aside from the extra money, it would give Apple the ability to say "See they really did copy us" as well as a nice "Don't anybody else try to copy us, because we will sue your @$$.... and win!"

They also sell more than Apple, which is why Apple is aiming for them.

And btw, the Galaxy Nexus ban is not in effect yet, it is on hold and there is a August 20th hearing scheduled by the appellate court :

Also, the Galaxy Nexus ban is not over "Slavishly copying" as some like to put it, it's over a Spotlight patent for unified search. Has nothing to do with design.

After this circus, I gotta say. I typically vote with my wallet and don't care how a company acts as long as the product is right for me, however after how many years of this going on now?

Apple is done getting money from me, taking to legally block other companies products, which are clearly not copies, over junk patents is an assault on my choice as a consumer, they are not deserving of a dime from me at this point, ML was my last Apple Purchase for sure, unless they clean up their act.

I see this, as a company has managed to sell more smartphones than Apple, by offering more modren phones, and more choices of phones at different price points, Apple has failed to do so, and have fallen behind Samsung.

So, what would apple do? Compete? Nah! Lets just sue them for beating us!

Apple, around the world. Loses far more lawsuits than it wins, and it loses a ton of its junk patents in the process, sure they get a victory now and then.

But these samsung phones, don't really look very much the same, use different hardware, a different OS, different software, different Apps, the experience is totally different.

So I would address the real problem as to why Samsung is beating my numbers. And start offering more than 1 phone.

With a Android phone you can have a real keyboard, you can pay more or less, you have have swappable batteries, different screen sizes, different OS's, just to name a few things you get with Android that Apple doesn't offer.

WHat does Apple offer right now? A couple exteremly overpriced phones for what they are.

I say over priced, because as of right now, my S3 blows the iPhone out of the water.

Then again, when the 1st iPhone came out, my Windows Mobile Phone blew it out of the water

Apple does offers iPhone prices from Free to $800 (on contract/off contract on the major carriers)
Keyboards and Swappable battery = clunkier hardware
Multiple screen sizes = crappy resolution for different apps on different phones (Rumored iPhone 6 Gen. screen is long so it won't screwed things up)
Multiple OS's = less apps on certain phones

I think Apple did everything right with iPhone.

While some might choose hardware based on its "sleek look", others would rather get it based on its usefulness. A phone is not a status symbol or a glamor accessory, it's a tool. A tool needs to be useful or a tool is junk.

Laptops and desktops have come in all shapes and sizes with different pixel counts displayed on screen for decades now. Developers have managed to work around those limitations without any issues because the SDKs and tools have been built to deal with the "fragmentation" (some would call it a feature, where based on price, you can opt for lower pixel count to save money or pay to get more pixels).

Android also has the concept built into the SDK. The iPhone could technically also, as it uses the same Interface builder tool that the Mac does and the Mac has different screen resolutions, pixel counts and even aspect ratios all over the line-up. And Mac apps aren't "crappy resolution for different apps on different Macs".

Its not free, the carriers make up the difference, and more often than not, you pay that back over time.

Swappable battery = much much much longer battery life if you don't have a place to charge, where I often don't.

Physical keyboards? They are great and they don't mean clunkier hardware.

I guess some people buy off looks, and some people buy off how well it actually performs, I am the former. I couldn't care less how something looks or how " sleek " it is. Which, lets be honest, my Galaxy S3 ( while it doesn't have a keyboard, which is fine. I don't type out tons of stuff on my phone ), not only looks " sleeker " than the iPhone, it has a swappable battery, and is still super light and thin ;)

This makes zero sense. So what your saying is that, every single desktop computer monitor should be the same size? Otherwise its all garbage...

Same goes with anything. the Iphone is no different, older models can't run lots of new apps.

If Apple was really motivated by money, they'd demand a blanket ban of all Galaxy phones and $15 billion. They are being quite reasonable in their punishment terms.

Really? Apple isn't doing this for the money? Which is why they sell extremely overpriced products? ( some are, some aren't. ). With massive profit margins? And attempt to legally block their competitors ?

I can't think of one " visionary " thing apple ever ' invented '.

iPod = Just an MP3 player with great marketing behind it, only one I ever had was an iPod mini, I liked it. Still have it...somewhere...

iPad = Just another tablet, that looks cool, was marketed well, with a rich eco system...still not seeing any innovation....

iPhone = Orignal iPhone was inferior in so many ways to other smart phones it was actually pretty funny, just another good product with good marketing. its a great phone, but I fail to see innovation here. I had a tablet WAY before the iPad, and it pretty much does everything ( no cell of course, this was 2005 ), the iPad did, just a bit slower, as its 5 years older lol. Still, no innovation.

Im not dissing Apple, they do make some great ( if very overpriced ) products, but they didn't really invent anything they claimed to.

Just because you were the first to make a product super popular, doesn't mean you invented it, or own the rights to it.

And I'm glad Samsung is eating away at Apples Marketshare, same with other phone makers. It'll spurr Apple to make a better product, which in turn. Spurrs Apples competition to make better products.

So as a consumer, I win.

To say the iPhone didn't innovate anything is crazy. The iPhone completely changed how phone operating systems work. Look at smart phones before the iPhone, and then afterward. Smartphones before the iPhone were clunky and didn't have great user interfaces. They may have had a lot of the features of the iPhone, but they were poorly designed.

Given Apple's high profile and it's ability to spin a story to it's advantage, the time spent in court is pointless. Especially since the trial is in Northern CA, involving a CA Corporation, Samsung has no chance.

Copying is a long held tradition that goes back one hundred years, involving more than that number of companies. Apple's squealing as though they are the only company in history that's ever had this experience.

Verdict?

Simple... Apple get's their way :)

Lets see, the first iPhone was a pile of crap.

My windows mobile phone had a great interface, I used it for years, got great work done with it, no issues. Oh yeah, mine was a little larger than the iPhone, but it had FAR more features, way more apps, and was faster, and had things like MMS, 3G, GPS, and fast processors, and decent cameras.

My phone was not poorly desinged at all, it had a nice slick UI, fast hardware, better battery life, and far more features than the iPhone.

The only real difference is that well, the Interface is more " flashy and bouncy " , and neither of those things matter to me.

Post 3GS, the iPhone has been awesome, but before that. I thought it was garbage.

I think people who really think the iPhone started some kind of smart phone ' vision ' clearly never used a smart phone before the iphone.

They won't get a bunch of phones knocked off.

To have that happen, they'd have to come after Google, and Apple is in no position to sue google over anything.

In the same way, that if the Windows phone ever becomes popular ( who knows! lots of people once thought The xbox platform would fail ), Apple would have no grounds to Sue Microsoft.
