I am betting he paid more for the phone but small claims court is great for two neighbors but the court has no "teeth". With luck you might get a judgment but that will not force the seller to pay back the buyer. A waste of time.

I love Craig's List, it has saved me a lot of money compared to dealing with eBay. But when you hand them the cash you got to know for sure what you are getting. The OP need have only checked the IMEI and he would have found out.

Call and told him if he doesn't give your money back, you are going to file a police report and proceed with small claim court. You will also be suing him for loss of wages, court cost and etc. Remember, you DON'T have to prove beyond reasonable doubt that he is at fault for civil trial, only 51%.
