Not every law that exists will be upheld in court... just look at some laws from the last century that are still around but would not last one day in court. Same with the DMCA, as long as it is not upheld in court it's worth a damn.

use handbrake to convert DVD directly to mov or mpg file (for movies)...you're not circumventing any decryption (like using mactheripper) so it's not illegal...

That's a pretty big stretch.

For example, it's legal to copy CDs to your iPod using iTunes, but not all CDs will let you do it. Look at the latest Song/BMG rootkit debacle.
