Uh, read step six in the OP:

6. Genius booked me for a Main Logic Board replacement. Apparently they are out of, or no longer carry 1.6 replacement boards, so I "had" to get a 1.8GHz instead (remember, CPU is soldered to logic board).

It's not clear the lie had anything to do with the 1.8 upgrade. The genius probably would not rely on the word of some stupid-looking punk (I don't know the OP, I'm just extrapolating from the posts). The genius would probably consult the service bulletins regarding the Air for that kind of info.

It *is* clear the OP went to the Apple Store with the intent to run a scam.
(The fact that he's proud enough of this to brag about it on the internet is why I assume he's a stupid-looking punk.)

You're a mastermind, wordy. You tricked them into not giving you something they didn't even have!

I'm not jealous. I could care less about an extra .2ghz. I wouldn't want a free upgrade if it meant I had to do what the OP did..I think thats pretty lame. Some of us still have moral's. It's few and far between it seems these days, but we are out there. :)

By reading the original post it seems that the OP's knew he would get an upgraded 1.8 board. If he didn't know this why would he bother going through all the trouble of what he has listed in his post?

Now that's something I can respect. you say your opinion without calling people A$sholes and retards. Although i think your opinion are wrong in this matter i do not start bitching about it.:) I respect your point of view.

But...

Under the Common law system, which applies to the UK, Canada, Australia, etc, you have committed fraudulent misrepresentation, that you knowingly used a false statement of fact(evidence is shown in the macrumor forum) to induce the apple genius guy, who genuinely relied on your statement, into contract to replacing your 1.6 motherboard with a 1.8 one (Derry v Peek). Alternatively, statutory claim i.e. Misrepresentation Act 1967 s 2(1) can be relied on by Apple to make a claim as well. It is a breach of tort law and remedy including litigation cost can be sought by Apple Inc. I recommend you get a lawyer soon.
Can you do my business law exam for me next week?

I agree with the morality and legality issues here, but the big question I cannot figure out is: WHY??

whats was the point of going to that much trouble and risk for a poxy 200MHz 'upgrade' on a system that really doesnt care if its 1.6 or 1.8 for what most people use it for???

Maybe its the 'go large' feeling?? Does anyone else here suspect a bit of cpu-envy going on and the need for someone who feels their 'system' is inadequate to 'go-large'???

OMG I haven't laughed at a pillock like this since my brother w00t-ed himself up for removing his air filter (thus gaining more power apparently) lol

Its refreshing to see that the majority here do not condone such stupid behaviour.

You wont go to jail for what you did, but Apple CAN void the rest of your warranty/applecare due to your fraud. Hope that Rev A is built to last, rofl
