Why would Apple be involved in this? To me it seems as thought it is AT&T's fault because of them being wary of it working well on their network. But it is ridiculous either way.
I can see more of a problem with that than being 3 days behind schedule. You'd probably have a better case as well, I don't see anything about the 2G iPhone that shouldn't make it not able to do MMS.

True, but one would assume that if it can run the latest software it can send a silly MMS message.
I don't believe they ever said late June anywhere. I hope AT&T terminates his service. TERMINATES!
AT&T had no contractual agreement about MMS in the first place. The sue-happy people can suck it.
But the fact that it can run is no basis for a lawsuit since Apple never once mentioned the possibility of the 2G getting MMS:

It's lawsuits like this that make me really wonder where our society's priorities lie.
Wow, you didn't have a feature you didn't have in the first place a couple of days earlier, so now you're going to file a class-action lawsuit and tax the system because you are hoping to make some ridiculous, pointless statement, or you just want some easy cash.
I hope this gets tossed out faster than Vanilla Ice's career.

When did this Minnesota complainant stop wearing white pants? If he wore them on the 8th of September, his suit (by his own defined parameters) has no merit.
I hope this gets tossed, their AT&T account terminated, and their iPhone confiscated. Like everyone here with a 3g and 3gs, I too waited a long time, now that we all got it why can we move on.

The problem with legalized random bitch-slapping is it will put more of tax strain on your dollar. There will have to be senate oversight committees, a Department of Legalized Random Bitch Slapping, etc.
It will just snowball to the point that it will take years until the first slap.
