I bought a 3GS for:

Battery Life - ruined by 3.1
7.2 MBps - i hit 1.2 on a good day
MMS - As of today 1 day of 65 days
Video - cripples without MMS

I'm paying ETF within a week of a new carrier.

You were never promised 7.2. The iPhone has support for 7.2Mbps, AT&T's network doesn't (neither do the other U.S. networks) and they never said they did.

As for MMS, same thing. They said it wouldn't be available right away.

This is where I don't see the government having any reason to get involved in random bitch-slapping.

I can't believe that none of you noted the obvious: post Labor Day isn't 'officially' autumn.

Summer officially ended this year on September 22. That was the beginning of the Autumnal Equinox. MMS came on the 25th. Hence AT&T was 3 days late.

The lawsuit is still a crock however.

This is just as pathetic as the lady filing a lawsuit claiming she was misled to thinking a crunchberry was an actual fruit. Funny thing is the firm that represented her also tried to sue claiming a plaintiff was misled into believing froot loops actually contained fruit.

I'm sorry, but at a certain age in your life you realize that "hot" coffee is actually HOT! and hot things do in fact burn. I honestly believe the lady that won that suit (about the hot coffee) paved the way for peoples stupidity to show and lawyers to find ways to make money off stupid people.

this part is more Apple then AT&T since AT&T is not the only carrier that doesn't have 1G 2G MMS. Seems the evil people at Apple might be trying to get you to update your phone. that's cooperate America for ya! but I will tell you once you go 3gs you will never go back! ;)

Are you really going to support monopolies? Spend some time in the history books and realize you are NOT the fraction of a percent of the population that wins.

I will support who I think is right. If you didn't care to check what the iPhone actually could and couldn't do and still bought it, it's not Apple's fault. The iPhone does support 7.2Mbps, AT&T doesn't, neither do all the other U.S. carriers. Why don't you sue them?
 
Hope the suit also includes sanctions for forcing people to get 3.1 to get the updated carrier file.

The iPhone has been around for 3 years. It got MMS yesterday. My mom's nokia flip phone that she got in 2003 (6 years ago) had MMS. Really AT&T?

And the fact of the matter is, AT&T promised 'late summer' and missed it. Doesn't matter if it was by an hour or a year, they didn't keep their promise.

the guy was saying how MMS has worked perfectly in Canada waaaayyy before AT&T allowed Americans to use the feature.., thus whatever beef this guy has should be with AT&T and not apple..

We had to wait to make sure Apple got it right, "user experience" and all that jazz. It was more important to get the accelerometer up and running so you could know how fast your iphone was moving. You would not want to get a speeding ticket now would you? ;)

I blame Canada! LOL

AT&T is the only one at fault. They are completely incompetent. I just got a call from a collection agency for a $521 bill due to AT&T for a data connect plan I cancelled back in July and another one I never had. I made two calls to AT&T and they started looking into it and the first person told me I would be called back in an hour. 2 days later when I called back they started again and unfortunately my coverage is so bad I was worried i would drop the call. The rep said she would call me back at home if it dropped. Of course it dropped and it's been 2 more days with no call. I have notified the BBB, NY State Attorney General and my local police to file fraud charges and I have notified my attorney to climb up their ass for potentially damaging my credit. I also sent a email to some higher ups at AT&T I know asking them if they would like to be served their papers at home or the office. LOL F'em
 
If this is a class-action lawsuit, then every single one of us better receive a part of any award money. Perhaps the credit will be a full month of SMS fee refund. Now, that I will support! :D
(note: this involves AT&T a lot more than Apple)
