I've heard that rumor before, but there doesn't appear to be anything about it in the iPhone Terms of Service.

I think the bottom line, though, is if you're willing to take the risk that the eBay auction might be a scam, there are fewer hoops to jump through than going the "traditional" route.

Thing is though, ATT don't sell factory unlocked iPhones.. which this could very well be. And although you CAN unlock it yourself if you have the right baseband, having to wait to jailbreak to preserve the unlock to update your phone is a nuisance.

Here's a question: does not having AT&T affect your ability to download apps and get software updates, etc.?

If the phone is unlocked via yellowsn0w then yes, it does affect your ability to get software updates.
If the phone is factory unlocked you can update as and when they get pushed out.
