There is one other downside to the Zune and every other player on the market; there's no video content. The average user cannot rip DVDs because of encryption. The Zune store has music videos, but ONLY Apple sells copyrighted movies and TV shows.

Why can't you rip a DVD you own and convert it to any format you want -- say .h264 or .wmv? I don't believe that's a copyright violation if you own it --but I'm no lawyer.
BTW, anyone buying videos from Apple is getting hosed because of the quality period. I don't know about the Zune store, but I'm assuming it's the same story. This is not even mentioning the fact that amazon sells movies digitally as well. I'm not sure what formats are, but I'm guessing .wmv is the most popular one.

It's a dead-on violation of copyright. Pop in the DVD and read the first page that comes up. It clearly says that the DVD is intended only to be seen in that format, and that the consumer has no freedom in changing or editing the content of the DVD.

I didn't read anything about ripping a personal copy and putting it into another format. That is not an exhibition or distribution of the copyrighted material. The term reproduction is really ambiguous because that could even include playback, or it could just mean producing an exact copy of the same DVD, which is not what you're doing either.

But like I said I'm no lawyer, but I've never said anything that has said "that the DVD is intended only to be seen in that format, and that the consumer has no freedom in changing or editing the content of the DVD."

The whole blurb "UNAUTHORIZED REPRODUCTION, EXHIBITION OR DISTRIBUTION OF COPYRIGHTED MOTION PICTURES CAN RESULT IN SEVERE CRIMINAL AND CIVIL PENALTIES UNDER THE LAWS OF YOUR COUNTRY." means that you can only watch the DVD. By ripping it for your iPod, you are making an unauthorized reproduction. A reproduction can be in any format, and can include any portion of the DVD.

Also, there should be a second warning page, I think an FBI one. That one has a better "Don't do" list.
 
Calboy, There's a little thing called "Fair Use" that has protected us for ages. Clinton & Bush, whoring for the movie industry, tried to steal that right from us with the DMCA. I ain't buyin it. They can write whatever nonsense they want to, it doesn't make it legal or moral. For example - by reading this you have agreed to and are contractually bound to deposit $1000 a month into my paypal account in perpetuity.

No, no other FBI warning on that DVD. As far as the whole warning goes, it seems like a pretty subjective meaning as far as I'm concerned as I pointed out it depends on how you interpret "reproduce".

Playing the devil´s advocate here, but if the FBI did arrest me for making a movie rip for my ipod off of a DVD that I own, I really wonder how far that would make it in court. Personally, I've never heard of anyone getting arrested for making a personal copy, but I have heard of people getting arrested for copying and distributing because that's what hurts the Movie industry, not me buying the DVD and then making my own personal copy.
 
Circumventing or removing copyright protection, no matter how easy it is, is illegal. The only way to make legal copies of DVDs is to retain the copyright protection, which a program by the guy who makes flip4mac does.

My grandpa once told me that the first time he saw television he said it was just a fad, he couldn't understand why anyone would want to give up being able to listen radio shows without needing to look at a device. :D

When you rip a DVD for your iPod, you are reproducing (copying, duplicating) the original content. The format it was stored on doesn't matter; what does matter is the content and information that you copied.

As for being prosecuted, it is unlikely, but that doesn't change the legality of it. Personally, I think that when you buy a DVD, you should also recieve a license for your iPod with it, but that's not how the industry wants to do it. It's up to us as individuals to decide how much we want to obey what appears on that copyright screen.

I'm not the one who thinks iPods are a fad. If you're going to attack someone, at least do it properly.

iPod killers are people who think that the brand-new mp3 player is better. I disagree, and some qualities of the iPod are good for some, but others could prefer otherwise. For example, i prefer the zune because i like the clickwheel, and the 3-inch widescreen is easy on the eyes. Others might share the opinion, but get lured in by too many iPod fans.

unfortunately i have to agree brown zune is a pile of poop with... *drum roll* green trim? Nice. MS arent the king of looking good. Brown is NOT the new white or black.
