Looks like you don't understand the difference between adhering to a TOS agreement and whether or not violating a TOS is an illegal vs. an unethical act, not so smarty for you.

Doesn't matter, there are these things called laws, a company can try and sign a contract where they pay you a $1 an hour. Doesn't matter the government says no. Why dont you go back to the 1800's with your ideologies.
 
So I went ahead and read through the TOS (iOS 8.1, the latest). From it, the only setence that I could find that really talks about jailbreaking or rooting is as follows:

You agree that Apple does not have any responsibility if you make unauthorized modifications to iOS (such
as by way of a “jailbreak”).

Now, there is a paragraph about reverse engineering and decrypting, as follows:

(d) You may not, and you agree not to or enable others to, copy (except as expressly permitted by this
License), decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt,
modify, or create derivative works of the iOS Software or any services provided by the iOS Software or
any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable
law or by licensing terms governing use of open-source components that may be included with the iOS
Software).

My understanding is that jailbreaking does none of those things. Further, Apple expressly mentions jailbreaking only in the context that Apple shall not be responsible for anything done to a jailbroken device.

The ethical issues are real.
Seems people are okay with ethical violations when it benefits them (jail break, file "sharing") but have a problem when Wall Street of business has ethical issues.

Your arguments are exactly the ones people on Wall Street use to justify their actions - they didn't break any laws.

Yes, it is totally legal to sell a poor little old lady your iPhone 3G for $3,242 because she is under the false impression that this what it is worth. Ethical? Nope.

Yes, you can have a TOS when you sell your bike to someone with the stipulation that they can't ride it on Tuesdays. If they do decide to ride their bike on Tuesdays, that act of bike riding did not violate any laws. But it did violate the TOS the person had agreed to.

I get that ethics don't matter to a lot of people. I am just always amused by how people rationalize it away.

So all the functionality provided by the IOS works exactly the same before and after the jailbreak?

And since its perfectly legal nobody can do anything about it about my choice not to follow the TOS agreement.

Although you say no one cares about my opinion, this is now the third time you replied, so you clearly have some issues here.

When you find yourself in a hole, stop digging. Try a different approach, like being ethical, and these issues will go away. You can be okay. It just takes some effort.

Perhaps the question of ethics regards to the TOS should be bestowed upon Apple. Much like the example that you provided of selling a bike to someone under the terms that they cannot ride it on Tuesdays, the TOS of Apple is equally ridiculous in the fact that it stipulates ways in which we cannot use a device that we paid for. It is natural that people break this BS TOS because Apple places restrictions that it is in no position to place. Futhermore, jailbreaking has been exempt from the Digital Millennium Copyright Act until 2015 which means that there is no reason for you to bring the issue of legality into this forum at all.

By the way, one of the rules on this forum is no trolling. If you interpret these rules as part of the TOS of MacRumors (which they practically are) you will find that by intentionally inciting anger in this thread, you sir are breaking forum rules and thus the TOS. Do you feel that it is ethical that you are breaking these rules/TOS? Also, what is your view on the ethics of being a hypocrite?
