I would consider that should the mesh wear out within the first year that it is a product that’s not durable enough to withstand every day use. The mesh is not cosmetic and is an essential part of the product. The AirPods Max are already weighty enough and adding extra bulk such as silicone mesh guards and ear cups, for me destroys the aesthetics of the headphones. If the mesh wore out in the first year then I would be on the phone to Apple insisting on replacement.
And you'd be within your rights to do so. The standard in the US at least for merchantability is "fit for the ordinary purposes for which such goods are used."

Agreed on the mesh. Anything that inhibits the actual operation of the product which the mesh headband is essential for it to function properly is covered. That’s the reason why Apple secretly (at least for now) allows easy swapping of the headband with a simple SIM ejector tool.

But a scratch on the earcups is another matter. And the reason why those thin silicon skins will sell. I equipped my two APMs with it and prefer that over a potential scratch Apple won’t do anything about.
 
Really? Have you even read Apple's terms and conditions for AppleCare+ yourself or is your advice based on hearsay as it appears?

If you actually read their terms and conditions you will see on the very first part - let me repeat that for those like yourself who don't read - the very first part specifically states:

"Apple will not provide Hardware Services or ADH Services in the following circumstances:

to protect against normal wear and tear, or to repair cosmetic damage not affecting the functionality of the Covered Equipment;"

I have AppleCare+ and I do due diligence and protect my equipments myself. AppleCare+ is an insurance, not a license to be THAT person.
Worst case scenario, you can intentionally break them to get them replaced under AC + for accidental damage, if you think they won’t replace/fix them over the mesh damage/tear.

Oh absolutely. Scratches and cosmetic damage I totally agree about and I can see the reason for wishing to cover the ear cups with silicone skins especially as the cups tend to bang together and I’ve already seen several photos from owners on reddit that have cosmetically damaged earcups
