As long as you still have a charge left, go to settings>general>reset>erase all content and settings, that will restore your phonw without having to connect it to itunes, and then you could tell the apple people that you were restoring your phone and it fall of the tabe while still attached to the cable, and something is now screwed up.

However, they know it is not activate due to the IMEI number not being registered with Apple or at&t.

reset all settings will still leave the phone "activated" but not really activated so it'll be suspicious no doubt.

and they go by the serial number on the hardware, not the IMEI number when checking for activation

huh?

i read somewhere they ask for your att phone number first to verify your account, so why not sign up then cancel after they replace your iphone??

I'd like to know what would happen if they were taken to court. Yes there is the technicality that you haven't activated, but you still have the receipt for your purchase and so should be entitled to a replacement IMO.

What would the basis for the suit be? A company has no independent obligation to replace broken product. You could bring a claim for breach of contract if Apple refused to live up to the warranty it provided on the phone, but the person in this case has already voided that warranty by unlocking his phone.

We're saying here that you return a re-virginised iPhone, to all intense and purposes new out of the box. The only reason people are saying Apple can refuse service is because you haven't activated with AT&T, which is just crappy.

Yeah it sucks. I had the phone since october and had no real intentions to activate it, until now. The phone is stuck in restore mode with the dreaded 1604 error. This error is because the connection between the computer and iphone is messed up. I know this for a fact. This is not because i unlocked it. Its legit. google it.

As for the warranty, i knew i was screwed. But this is a hardware glitch. its not like a bricked it. Even the "genius" couldn't get a connection between the computer and device. he said "hardware error". i've unlocked multiple phones for people and know it wasn't bricked. The fact was i had to insert the USB cord into the computer a certain way for the computer to recognize it while it was in normal mode.

Right now the phone is in the restore mode and WILL be recognized by the computer, but as soon as i try to restore it in itunes the connection is lost. Something with the normal mode just won't play right with the computer. I reset the firmware to 1.0.2 before i took it to the apple store, AND THIS RESULTED IN THE CORRUPT FIRMWARE BECAUSE THE CONNECTION TO THE PHONE WAS LOST IN THE RESTART OF THE DEVICE.

Technically i'm wrong for unlocking it, but, it's not mentioned on the box of the device about unlocking and warranty. ALSO. on apples website it mentions this when i punch my serial number in

"Our records indicate that your product is covered under Apple's Limited Warranty which is estimated to expire on Sep 10, 2008.

Your product is eligible for complimentary phone support which is estimated to expire on Sep 10, 2008."

So technically that skirts the activation rule.

It just sucks having a $500 paperweight, and a paperweight that isn't even heavy. Basically, it won't let me restore the device since it disconnects

For all the people that said i broke it unlocking it, I call BS. Why else would the USB cord need to be jiggled in?

am I wrong or what, it seems you should be able to sign up with att , take your phone to apple give them your number , go home with your newly swapped iphone and cancel your contract, 30 day free ride to try att service

SAY YOU WANTED TO ACTIVATE FOR THE FIRST TIME, as your secondary handset but via iTunes but never got a chance to come into Apple Store due to work not permitting time. But on the first instance that you plugged in the iPhone this happened. THEN WHAT WILL THEY SAY???

try this

30-day trial—use the phone for up to 30 days to make sure it’s the one that you want. If you don’t like it, you can return it to the closest AT&T retail store, and exchange the phone or cancel service without penalty. Note that you are still responsible for airtime and data usage charges generated before the phone is returned.

Just spent the last five hours toying with it. Fixed it. Take that you King of Prussia "Apple Genius". Turns out under the normal mode of iPhone, it doesn't recognize the USB ports all the time, so for a firmware restore you have to unplug it when it says waiting for phone and all. There is a split second where you do it, and you MUST do it under Vista or XP so you can see the status bar.

It takes a bazillion tries, but i got it. I used the 1.1.1 firmware and its solid(ly finnicky with the USB) but it works. Phew. I was scared of having a $425 dollar paperweight.

But this is a major F-U to Apple on this one. Big deal people unlock them, you still make $400 on each device. Apple is turning into Microsoft. I said it. I love my 8 core mac pro, leopard, final cut and all, but recent actions in the customer service realm and how they always nickel and dime people (ipod touch apps) is just ridiculous.

1) why is everyone saying just activate the phone?
you realize you can't activate an iphone if it can't talk to a computer right?

2) they won't ask for your phone number, they'll look at your serial, pop it into the database and it gives them the date and time it was activated. no activation = no service.

3) there has been stories of them refusing service to "suspicious" people as well. meaning you purchased the phone in september, activated it randomly yesterday, and now today you have an appointment at the genius bar. i have to admit, doesn't take a genius to figure that out. i don't know apples official policy on this though, but i've heard it happening quite often.

4) they don't make close to $400 a device, more like $75-160 depending on the model, this is the reason it's tied to a carrier and cheep. remember the brief stint on legit unlocked phones in france/germany? how they were crazy expensive? think about it. the get kickbacks from every iphone-using AT&T customer on the network each month from AT&T

Are you serious? Apple has a exclusivity contract with AT&T and they get a cut from what AT&T users pay monthly. Of course, they're going to want to see their product used by AT&T subscribers. If they don't want to, then AT&T will want them to. It might even been part of their contract. You're using it on Verizon. They don't get their monthly bit from you. Why should they help you? Why did you reset it in the first place? Because it's not under warranty if you jailbreak it. So why is it any different if it's unlocked? It's still not under their warranty.

If they fixed/replaced iphones which were jailbroken and/or under a different provider than AT&T, they might as well null their contract with them. They're trying to discourage using other providers that by not offering support, which gives people incentive to transfer over to AT&T to use the iphone.

Im certain that apple will release an unlocked or at least PAYG for all who want iPhone as this would potentially boost the iPhone sales... however what i reckon they would do is sell the unlocked one at a higher price maybe 100 or so pounds more and thats given to network so they dont make a total loss... that way you will get a warranty.. i reckon the stupidest thing apple did was sign an exclusive agreement with a provider in each country... if it was sim free they would be flying off shelves like hot cake, probably having to replenish stock every three days..........

Apple will sooner or later realize they are shooting themselves in the foot...

Or at least i think they will make it slightly easier / not prevent / brick unlocked handsets even if they dont provide a warranty as its the handset they wanna sell...

sooner or later apple will realize their behaviour is totally unacceptable and have no right to deny warranty to people have purchased iphones and unlocked them....

drain it until it goes out

then call applecare and tell them it wont charge. Theyll make a reference for you

then go to the store and get your replacement when the guy inspects it and double checks that it wont charge.

My friend (I live in Canada, he does too) called apple and made an appointment, and got a replacement no problem.
