im currently in the process of drafting a legal letter to O2 Ireland about this issue.

the iPhone contract is, in parts illegal and will not hold up in court. i cant go into too much detail now, but if the letter is ignored my legal representitive is ready to go on them!

i will be posting the result here and in other blogs

Why don't you wait and see what they do? Everyone seems to be assuming that o2 wont unlock, but we wont really know till vodafone launch the iphone.

because essentially they should never have been allowed to refuse to unlock it.

an "exclusivity deal" is not a law, it does not in most circumstances give companies the right to dictate what a person does with a product once they have completed the contract.

There's no actual law about unlocking you know. They don't have to do anything. Just saying.

I think also that any O2 owners (includes PAYG & PM) should be able to unlock so that when in different countries they can take advantage of cheaper rates from other "local" providers and even offers fro UK providers (like the recent vodophone offer). When I used to travel a lot it was essential to have an unlocked phone. It's not so much for data but for calls and texts.

But JB is still illegal, right, according to Apple law?!

Can I bore you with my reason for wanting unlocking...

"I'm not banging this drum for myself, I have no intention of leaving 02 anyway, I'm quite pleased with their service.

I gave my neice, a medical student doing her Master's degree here in London, an iPhone 3gs as a gift as a reward for completing her exams. Now she has been offered the chance to go on and study for a Phd.

This involves travelling, she is in US now, then to Canada for a month, then Sweden, London and Paris (That we know of so far).

So why can't this medical STUDENT have use of her pay and go phone, for which we paid top dollar, without incurring extortionate roaming charges for these extended periods.

I can understand locking for the duration of a contract, but pay-and-go is not a contract, and people paying the premium price for their phones should have the extra facility to unlock. I would even contemplate paying a fee to do so."

Nope..not about unlocking specifically. But, the European Union Directive on Unfair Contract Terms states is the law which O2 is violating.
That fact that O2 refuse to unlock just the iPhone (Even though all other phones can be unlocked) and even after your contract is finished, they will not unlock for you, violates this directive. O2 Ireland refuses to comment on it..just saying that it's apart of their deal with Apple...

once the letter has been received by O2 i will post its contents here, unless it goes forward into the legal route in which case i wont be able to discuss it until it has been resolved, but rest assured, once i start something, i dont stop, and this issue will be resolved in the consumers favor! :D:apple:
