I mean it make sense, but then I am surprised that even my M3 has the same issue. It is noted that I didn’t have this issue when I first bought it earlier in winter, now it’s scorching 35 degrees indoors summer heat 🥵 and all of the sudden I started to have this issue for the first time since I bought it. It is very annoying as sometime you left up the entire weight of a MacBook Pro 16 just to open the Lid
Close the lid with something like cardboard between the gasket and the top-plate’s palm rest front. Something thick enough to stop the gasket from sealing completely and see if the issue persists. Another thing you can try is wait until you have oily skin, and rub some of that along the gasket to see if that makes it less sticky.

I have an similar problem during opening M1 MBP.
Is that guys what you talking about?

This is the first video I could find after a lot of research, that shows the exact "problem" and sound that I have with my MBA M3 13". Every time I open it, its like this but if I open it once, then close it and immediately open it again, then the MacBook opens as it should, which means that there is no real defect.

My MBA also has a slight gap on the left side between lid/rubber and the bottom part of the MacBook case. When the lid is closed, the gap can be closed or reduced by applying light pressure with your finger. But the gap looks significantly thinner to me compared to what I've seen in pictures of other MacBooks, so its probably in tolerance and no real problem.

I got this MacBook from Apple Certified Refurbished one month ago and it's working perfectly fine. (It's probably a returned unit and the pre-owner didn't want to live with the gap and opening-sound. 🤣) But that's no deal-breaker for me, I just was unsure about how this problems will affect longevity of the MacBook.

It seems like this problems are very common and I even read that people had to request multiple replacements until they got a perfect unit and that's definitely not the way I want to go. I will get AC+ to be safe (even when the terms here in Germany say, that damages caused by design defects are not covered 🤨) and just use my MacBook without any worries from now on.
