Class action lawsuit lawyers are generally not a bad thing. There's usually a good reason. This, however, isn't really a good reason.

As for ambulance chasers... they are the reason the rest of us have to pay extremely high costs for health care, and they should all be thrown into the Grand Canyon and burned alive.

To Challenge why health care cost is so much, a little off issue I know, but I believe it is more the illegal alien population having children and/or undergoing medical procedures and then just bailing. Not giving any concern to paying back the cost of their treatment. Then I have to pick up that cost with my outrageous premiums.

It is a lot more complicated than that.

I enjoy people who who aren't found of me.

Lots of people think they hate us right up until the day when they need us to save their bacon.

Agreed!

And to the OP, you seem to forget that lawyers don't just bring lawsuits, it takes individuals who believe they have been or are about to be harmed in some way to bring a lawsuit, lawyers represent their interests, and Apple's interest when they are sued.

Yep, I'm sure they'll win this one!

No, not really. I'm willing to be that any defective battery will be replaced within the one year warranty and with Applecare, you will get 2 years of hardware protection, software support and battery replacement for $69.99. Problem solved, just follow the guidelines for charging and I'm sure the battery should hold out through your contract. Have fun chasing ambulances! Hey, while your at it, go after every single laptop manufacturer not telling you your laptop battery actually has half the battery life if you actually plan to have fun with it. Running discs, full screen brightness, playing games, watching movies...etc...etc... Oh yeah, how come I have to change the oil in my car? Why can't it just last the life of my loan?

Now let me get this straight.

We all basically knew the iPhone would NOT have a user replaceable battery, just like an iPod.

Apple released the fact that the batteries will average 400 charge cycles.

The iPhone was released just last Friday night, and people under free will and with this knowledge available, purchase said phone.

Approximately 8 days later there are enough people banding together already to possibly sue Apple over a product that they can still return for a refund (less small restocking fee)?

This has got to be one of the stupidest things I have ever heard.

Not sure whether I am more upset at the moron consumer or the money chasing lawyer(s) .

Commonsense, it seems is not that common anymore.

There was a great post here from a link to the Apple site that mentioned that only charging from a dead state counted as a charge. That if you are at 50%, it would take two charges to count as one.

I recommend you re-read my original post because clearly you didn't read it the first time. I did address that issue and I know full out an well that 400 cycles means 400 from dead to fully charged.

Keep line in there was the fast people seem to going to a nearly dead battery every day means almost every day they have to using a full charge cycle. I gave a 1.5 years (550 days or do) to off set fact that it full cycle every day but a near full cycle....

Really I suggest you read closer before you flame me. My post did cover the fact and correctly burned apple. Do not blindly defend apple since you clearly failed at hitting me on the 400 cycles because I address it in the 2nd line of that post of mine you quoted.

So return your phone.

well they have a slight case. 400 cycles in that battery is maybe 1.5 years for most people if not less because it seems like people are being forced to charge there phones from nearly dead every day.
Compare that to my cell phone battery has about 400 cycles life span on it and I charge it once every 3-4 days and that is including 1-2 hours of talk time on it.

That means my battery will easily last over the 2 years of my contracted and until I would replace my phone again and hell even longer if I wanted to push it. The life span of iPhone battery before it needs to be replaced is crap for a cell phone if it can not easily last 2 years. Top it off they charge nearly 2 times as much as everyone else for a replacement. Require you to go with out a phone for 3+ days and will charge you 30 bucks for a loner. That does push it well over 100 bucks for a battery replacement. I can completely understand why the consumer watch dog groups are going after apple on this one and quite frankly apple deserves it.

I thought twice about defending this topic to someone named "Rodimus Prime" but I feel this is an issue of certain concern because many (People o this message board, News sources and the Foundation for Consumer and Taxpayer Rights included) have gotten this issue wrong.

Rodimus, your statement makes it clear that you are not aware how Apple claims their battery will perform.

Apple says: "A properly maintained iPhone battery is designed to retain up to 80% of its original capacity after 400 full charge and discharge cycles. You may choose to replace your battery when it no longer holds sufficient charge to meet your needs."

You say that the iPhone's battery will be useless after these 400 cycles, which is obviously not the case. The battery will be at 80% of the original capacity. So if your talk time is currently 8 hours, it's now 6.4 hours.

Your statement about how long the battery "lasts" is prevalent throughout news articles I've read commenting on the battery. These statements of customers "blasting" Apple/ATT are ridiculous.

Am I missing something?

So, Apple posts battery replacement procedure that some customers don't like. If replacing the battery is too big a hassle for you, then don't buy the phone. Sure, the first few hours of customers didn't know this, but since Apple has a history of difficult/impossible to replace batteries in portable devices, this is not unexpected.

I suggest that next time Harvey Rosenfield goes to the store, he ought to pick up a pack of untwistable panties. It'll make his days a lot more comfortable.

Given that they posted the process, cost, timing, anyone who pays attention can know. If I'm apple, I'd offer a full refund now to anyone who complains. Just eliminate their complaint.

I understood your points. But 10 days in in owning an iPhone (for those that bought on the first day) is a little soon for talk of a class action lawsuit IMO (and some others here).

In my first couple of days with the iPhone (bought on 6/30) I was charging from a near dead battery. Only because I was having fun with it. Now that I have gotten in to using it more the way it was intended - at least for me, as what I like to think myself as a typical consumer - I am now going a day and half between charges. And that was before learning how to turn the iPhone off - at my job I am not allowed to have a cell phone on the sales floor unless I have a compelling reason - and then I can not answer that call on the sales floor. Or saving battery life by turning off wi-fi when I know there is not a network that I can access (either free or that I have a password to). Or turning off the BT when I know that I will not need my Jawbone.

These measures, some of which I used with my Treo 650, will help me in the end. Did I need to listen to my iTunes on the iPhone over this past week? Nope I have a 60GB Video iPod for that. Why did I do it then? Because it was cool and new.

Given that the iPhone is using OS X, maybe Apple will give us power saving modes as a menu option. Easily selectable menu options in order to get the best battery life.

One technology that I wish Apple had put in place about the battery is the one used by the Nikon D200. The EN-EL3E battery on the D200 actually shows you the expected life of the battery as you recharge it!

Some of us are not trying to flame you. But this early in on a consumer product, some are looking for more than it is. For if some one is using it for business, and needs a battery in a year or a little more - the charges that Apple has stated are a business expense. At 400 charges for the battery - that means 1.8 days between charges. I think that in a month or two we will see 80% of iPhone users meeting the two year goal for battery life.

To Apple's credit, I was never given the option to rent a Treo 650 if it had to be sent in for service. OK, buying a replacement battery is about half the cost of sending my iPhone (based on Sprint pricing). But the Treo's of today pale for my use, verses what I enjoy with my iPhone.

Maybe the iPhone 2 will be the thickness of my Treo and offer interchangeable batteries, GPS, HSPDA, and all the rest of a full PIM offers. But the initial specs and now the final ones BEFORE we bought never promised that.

Just a few more than my two cents worth....

Sorry for the quick follow up post.....

Thanks for the info. If this in deed the case I think I might just be able to live with the current iPhone for the next two years....
