Just to clear up some facts - the computer was not DOA, it worked for a week and then I guess the mobo tanked. That's why Amazon doesn't want to give me a return with no restock fee, they insist on taking 15% out of my hide.
 
You have two choices:

1) Return it for a 15% restocking fee and order the iMac with the card you wanted.

2) Get it repaired through Applecare (I don't believe they'll refuse to repair it).

Amazon doesn't have to give you a return, because they shipped you a working product, and their sales policy on computers says basically anything not DoA is the responsibility of the manufacturer.

So if it's fried, you need to go to apple. If applecare via the phone isn't giving you any help, look up certified apple repair centers near by. Give the closest one a call, and tell them your issue with the computer. They should be able to let you know if its something they can fix under warranty. Remember, repair centers will want to open up the machine and fix something, thats the only way they get paid. And if they can bill it to apple, all the better.

The biggest thing is what exactly is wrong. If its just "poor performance" then you might not be able to get anything done. Or you might have to gamble on paying for a diagnostics test at a repair center. I had the same thing happen to me once. I had a tower that was damaged, I agreed to pay for a diagnostic, and it turned out to be an issue apple agreed to pay for, meaning they paid for the testing, replacement parts, and labor.

I'm shocked to hear amazon is taking this position. In 2005 I bought a powerbook G4 from them and when it was DOA they took it back, no restocking fee, and they even covered the shipping.

If I were you, I'd try to escalate the problem within amazon. Apple has to fix it, but they have no responsibility to swap it. Amazon is the one who needs to do the swap.

Problem is they won't swap it out without a restocking fee because it wasn't a DOA and the OP wants to return it because he's unsatisfied with the graphics card, even though it might be having problems.

Just to get things straight, I was unhappy with the graphics card, THEN the mobo tanked as per Applecare. So maybe I got a lemon. Before you accuse someone of lying you'd better be able to back it up.
 
Apple will be more than happy to replace the logic board if you send it in. So why are you still fighting with Amazon.....unless of course you want to return it.

I agree. Call up Apple and see about shipping it in for repair. It's covered under Applecare.

Get Apple to send you a UPS box and mail it in to them.

They just did this with my 2 year old 23" Cinema Display, which was under Applecare three year warranty.

They paid for 112 dollars in shipping. I'm about to hook up the replacement Display. I brought it in on Thursday and got it back today. VERY GOOD SERVICE, APPLE.

Having never bought from Amazon, it seems like a headache. But don't think that Apple is not going to repair your nearly new machine. THEY WILL.

Just ask for a shipping box to send it in to them.
