Well, I couldn't wait for my self imposed 2 week deadline - I received a rather important IM a few days ago and got this:

1/ No SMS notification. Still broken, I guess, even though there's no mention of it when you configure it, or any mention of it's current status on the blog.

2/ My buddy list showed the message but when I tried to read it the program simply showed me a black screen. (Not the first time)

That was the last straw. The only part of the IM I could read was the first few words in the "current chats" window but as soon as I selected it I just got the black screen.

Blog updates are now far and few between, I still don't see the buddy list updating properly based on my observations, and SMS notifications (ESSENTIAL until push is released IMHO!) is still a mystery if/when it's going to work. Add in the fact that I was still finding my AIM account logged out at least once every day or two (pointing to a continued lack of server stability) and I'm just done.

I removed my review (which was propping up the Canadian appstore star rating pretty well due to it's weighting) and requested a refund today. I bought Beejive yesterday and am quite happy so far.

I laugh every time I hear someone contemplating a lawsuit over $3.

Yeah, it's not working as it should, but it seems that nobody is having any problems getting refunds, so that should remedy everyones issue.

Well now it's working for me, yeah theres some bugs but it's bugs that make it seem like it's the first edition of MC3 not 3.1 but so what hopefully this time they'll update in half the time

They should be sued for every penny they made on the app store.

The most you can legally sue is $3...but the court costs, time to sue, etc. are well not worth just asking Apple for a refund. And you'd be spending more money to get back $3 than waiting for a refund.
