Need Help How To Skip At&t Data Plan??

You're good up until step 3. You want to have the iPhone activated before adding a data block to the line because as soon as you activate it in iTunes, a data plan will be automatically added. Of course all of that can be avoided if the iPhone you get is already activated.

I purchased a 2G that was a refurbished phone so I could get little warranty out it and know it works. I just got off the phone with AT&T and they insist that I have a monthly data plan for any Iphone even the 2G. My question is how do I activate the phone through Itunes without adding the data plan to my account? Does it stay activated if I add it as a device with a data plan and then pull it out of my account? Once I can get past the activation issue I will do the simm card switch with my old phone and the block data.
