Samsung sued after Galaxy Note 7 explodes in pocket

"With all those reports about Note 7s burning flesh and setting vehicles on fire, you're probably wondering when you'll hear about a lawsuit. Well, here you go. A man from Florida named Jonathan Strobel has filed a lawsuit against Samsung over an exploding Note 7, and it could be the first of its kind in the US. According to Reuters, the phone blew up in the plaintiff's pocket while he was in a Costco on September 9th. It reportedly caused deep second-degree burns to his right thigh that's about the size of the phone, as well as to his thumb.

That's a week after Samsung announced its recall program and the same day the company started planning for an official recall in the country with the US Consumer Product Safety Commission. The CPSC finally launched an official, nationwide recall program for Note 7s on September 15th. "Unfortunately," Strobel's lawyer said, "for my client [it] came too late."

When Samsung first announced that it's taking back units it already shipped, there were only 35 reported cases of batteries overheating. That number climbed until it reached 92 cases, according to the CPSC. Since replacement Note 7s won't be available until September 21st, though, most buyers still haven't turned theirs in yet. A Samsung spokesperson refused to talk about the case with Reuters, but she urged "all Note 7 owners to power their device down and exchange it immediately." As for Strobel, he's now seeking damages for medical bills, lost wages, pain and suffering, along with other injuries."

I'm suprised there haven't been more law suits in the US. They are so trigger happy with these class action law suits. I mean if they can sue a company for not being able to get a phone on day one then owning a phone that has the potential to blow up in your pocket, that should be big bucks. You'll be set for life lol

But prior to people knowing - then he's got some rights

Which is hardly different than when iPhone users sue Apple for whatever reason like iOS9 slowed down their 4s.

Stupid him.

It's been known for weeks that the phone is recalled.

This happened on Sept 9th. I can tell you that plenty of users did not know about the recall. I personally didn't get my first notification about the Note 7 until the 14th from T-mobile, and then on the 15th from Samsung themselves.

Gotta love click bait headlines and lawyers, using "exploding" to make it sound more dramatic.

Perhaps someone should toss them a flare in one hand, and a hand grenade in the other, and ask them to describe the different damage results between a burn and an explosion.

Even the Consumer Products Safety Commission describes the problem in the official recall, as:

"The lithium-ion battery in the Galaxy Note7 smartphones can overheat and catch fire, posing a serious burn hazard to consumers."

I know, right? I remember one time I updated and it caused a little lag. Next thing I know, pain all down my leg and I needed medical care. Because slightly slower phones cause medical problems.

Everyone reporting the galaxy note 7 exploding is accurate.

I would say more like an Eruption. A shock wave from an Explosion wouldn't be so directional. The display would be in pieces before in got the chance to melt.

Depends on the intensity.
Don't forget of the added pressure from the 3,500 mah battery packed densely into the cell and the wall separating the negative and positive poles is quite thin and now identified as the point of failure, causing the note 7 to combust or explode, then what remains ends up burning.

Display is gg 5 doesn't shatter like normal glass.

Erupting doesn't make any sense.

More people should sue Samsung especially the guy who had his jeep get burned down. Use it as a hard lesson, Samsung.

Even if with all this recall fiasco and being banned in airplane flights, guess what? Don't hate on the Note7. You know it is still one of the best smartphones out there with arguably the best camera. I watch Note7 v iPhone 7 Plus camera comparisons and the Note7 is beating it. Note7 took better than the pre-production V20 in still shots in my eyes too. You're wrong, Lanh!

For me, I shall w8 for the 8. I am still open to Note8 if Samsung does this -

+ Bring back removable battery
+ Metal, removable back like V20
+ 4K display

The last point is likely. I used to be one of those people who said anything higher than 1080p is a waste on battery. Now I am becoming a VR enthusiast. Will skip VR this year and wait for 4K to make VR sharper. Buy V20 to keep my occupied until Samsung makes the Note8 great.

Technically, Note7 is really supposed to be called the Note6. Ah yes, the devil number with hell's fire burning in people's pocket and hands. Don't like the number 8 but it is lucky for the Chinese. The real 7th gen of Note arrives next year with hopefully more luck on its side.

Samsung just needs to take the negativity as motivation. The Note8 will be what the Note7 should've been...

Most innovative are LG and Samsung with their foldable displays.

Samsung is worth billions. Lawsuits by people is chump change compared to the recall they went through. It's like random people who sued McDonald's for slipping on the floor or whatever. Even $10M-$20M settlements is nothing to Samsung. Is anybody gullible to think Samsung is in red ink after this recall? That's like posters here actually believing for a minute Donald Trump will be President from the recent polls. Haha.. Sure!

Sony and Toyota went through a recall and both are still doing fine. Samsung will be too. McDonald's and Apple go through lawsuits all the time. Remember when someone sued Apple a decade ago because the iPad nano rear scratched so easily? Any idea of doom and gloom talk for Samsung is pure hyperbole, blind hatred, and sour grapes on your part. They still have more cash to throw around than Clinton and Trump combined.

"Bloomberg reports that while the company's phone division blamed the fault on battery manufacturer Samsung SDI, managers there suggested the cause might be the Note 7's design. The publication reports that the chairman of the US Consumer Product Safety Commission echoed this charge last week, saying on Thursday that the Note 7 battery was slightly too big for its compartment. The Verge has contacted Samsung to ask for clarification of this issue."
