I'm saying that, in this case - with the nexus one. I understand where the money is going, and would not feel ripped off if I chose to breach my contract (if I had a nexus one)

As far as I can tell, I legally would owe them $200 (per the linked article in the original post). And that's it. there is no $960 being charged to anyone??
I'm going to spell this out ONE MORE TIME. If you don't get it, too bad soo sad.
In the 'past' the ETF fee was for the cell phone subsidy. You had no ETF for canceling your service. Essentially you had a month to month plan with a 2 yr contract ON THE PHONE.
Then you had Verizon added a contract on the PLAN with no option of a month to month contract forcing you to pay a new service etf.
In this case the 350 etf you pay is for the hardware. That means the 200 ETF has nothing to do with the hardware. So legally the ETF T-mobile charges you has to related to a service contract. Same case as Verizon.
Do you get how this is a downgrade? Before you had no contract on the service and no etf on the service. Now with t-moble and verizon you do.
As for the 960 ($40 for the cheapest service x 24 for the months). Legally if you are canceling a 2 yr contract you owe the money that you would have paid over all those months. So while they are charging you 200 right now, they can easily change up all the way up to 960 for everyone or higher for a more expensive plan.
By saying you are 'okay'' with this you are saying you are okay getting ripped off now and even more in the future.
If somebody buys the Nexus One and wants to cancel between months 2 to 4 they're stupid. You get 30 days to try out the service and you can cancel between days 1-29 anyway. Besides selling the phone on eBay would recoup $300-400 dollars. I put my 3GS on eBay and I got enough to get the Droid and pay my AT&T ETF with still a little change left in my pocket.
