Except that apple is not going to let it be tethered. This isn't a case of taking a blind eye to jail breaking but rather slamming the door on people. You need/want 3G access, you'll need to but the unit, not hack or tether a wifi model.

Uh, no. Apple can't stop that. All they can do is stop AT&T from offering an iPhone to iPad tethering plan. Which is odd, as thy added tethering to the iPhone OS so you would think they would WANT you to have this option (selling an iPhone AND an iPad w/ wifi is probably much more profitable than selling an iPad 3G by itself).

let's also keep in mind here - that Apple gets the full iPhone price from AT&T. i.e you may pay 200$ to AT&T but apple still gets that good ole 550$.

Right now, the infrastructure isn't as big as the developer's dreams are. Everyone slams AT&T but they really are very reliable, and actually are the fastest.
 
As many have mentioned the hardware is lacking from the WiFi model.

Here is a picture from Apple's website. You can clearly make out the model with 3G, I'm guessing that the plastic top houses the 3G antenna to help with reception.

Left WiFi only and the Right is the 3G model.
