The phone got to the US from china relatively quickly then it came to my city, rerouted to another state and two days later, they tried to deliver an empty box to me!

....and what did Apple say? I assume you ordered directly from Apple since you mentioned ship from China.

I'm sure they have policies in place for lost or stolen shipments. Contact them right away if you haven't.

Yes. It was direct from apple. Took them 48 hours to investigate and issue me a refund.

What do you mean? As far as theft goes it's probably just someone throughout the distribution channels/shippers/warehouses.

Apple will mark phone stolen (tied to IMEI/serial number) so it can't be activated again, but that won't matter- since the thief already got their money from resell. That's why you should NEVER buy a used iPhone.
