So that's 2 people in this thread. Basically looks like a small number of units basically have a hardware fault then. Unlucky I guess. I really hope the store can just swap mine straight over.

Just wondering if anything else could cause it. Do you guys use a case with your 4S and if so which one? I'm using a rocketfish case which is basically like a rubber bumper with a clear plastic back. Obviously it's not design specifically for the 4S but definitely no part of the case is covering the buttons or anything and it's not too tight.

I've been using the phone daily for music and using the volume buttons and never noticed the problem until today when it suddenly started happening. Now it happens virtually every time I try to do anything with the phone.

I actually thought about this as well - I'm using an InCase Slider with mine. Nothing's touching the buttons, but I did wonder if it could have perhaps exacerbated a pre-existing design flaw or something.

----------

So a Genius "immediately agreed"? Tell you what, I'd fire this genius immediately if it were up to me.

I have a iP4 that's never had this issue. It started happening just now with iOS5. Happened to me just once actually since I upgraded the OS. Definitely not a hardware issue.

Good thing it's not up to you, then.

This volume issue is getting worse and worse. Now everytime I unlock my phone the volume attempts to increase. So if the volume is already up full blast, the stupid volume icon stays on the screen blocking my view of what I'm doing. Major PITA.

Got an appointment at the apple store this wed to clear this annoying problem up. Hopefully they hook me up with a new device as well.

EXACTLY the same thing is happening to me too. I'm going to the store on Wednesday too hopefully for a replacement. Really not happy and I'm also worried about it happening again :/

I have this issue too, but for me it's the minus button which goes crazy. Even holding the iPhone in the hand causes the volume to go down to zero if i have SLIGHT contact with the minus button or the volume button area :(
Slighly touching (not pushing!) the minus button results in the speaker icon to appear and the volume is completely leveled down to zero, even if the minus button isn't touched anymore. It takes some time to level the volume back up cause the Phone tries to level it down some time :(

I am using my old iPhone4 Bumper now which makes the iPhone useable again, it happens far less often with the bumper. I can't use the iPhone with my beloved Incase Slider Case :-(

Really annoying hardware fault. I called the german apple support and bought the ACPP. I am getting a new 4S. The guy at the hotline claimed they haven't heard of this problem before. Hopefully this won't happen again, but i fear it will come back someday. So it's better to get the ACPP IMHO. I want to use this iPhone Model for some time. I like the 4S really much. The camera is really great, the speed is amazing and siri a nice hands free toy while biking.

I got my new 4S today via UPS Germany. I restored from my 4S Backup. The Problem is completely gone, the Volume Buttons work as they should now. They are a little harder to push, which is okay for me.
The exchange of the new and the faulty iPhone went smooth. I got a Mail with Serialnumbers/IMEIS of the new and old iPhone one Day before the exchange. The Mail even contained both UPS Trackingnumbers. The faulty one is already enroute to Apple Service Netherlands.

I was able to make it to the Apple store today so I was able to exchange my 4S for a new one. Luckily the phone was acting up with the Genius was looking at it, so it was an easy sell to get a new one.

The new one is working fine so far, just restoring all my data back to it now.

My genius appointment is in a few hours. The other day a store manger said he would save a phone for me to swap. Hope it all goes smoothly as I have a 4 hour round trip to the store!

My white 32gig is doing the same thing, do I exchange it at Radio Shack or the Apple Store?

Went to the Genius bar today. They saw the problem straight away and swapped the phone over.

Wanted to ask you guys who also got theirs swapped, when they got my replacement it was in some kind of black storage box, not an original box. They assured me it wasn't a refurb or anything and it seemed brand new.

Everything seems fine with the new one, though maybe I'm being paranoid but Siri sound slightly different, almost slightly muffled like the speaker is faulty. Except everything else like music etc.. sounds normal. Am I being silly there or what lol?

my iphone 4 does, too

Just googled around for this issue,
I've got a one year old iphone 4.
I have never had any problems with volume on my phone until I updated to iOS 5. After the upgrade I experience the sam problems that you are talking about; increased volume when receiving push-messages, mms, texts, and also sometimes by itself.

It surely is a software problem then, but are there any more iphone v4 with iOS 5 having the same issue?

I am having the same problem with my new 4s. Do I really have to get a new phone to fix it?

Okay everyones it'a alright! I got a new one! Problem solved. No more insane volume demon. I know you were all probably worried. You know, we were all lucky in a way. To have this rare problem. Some may say unlucky, but I say it was an honor. I'm glad that I could be apart of something bigger than myself.

This just started happening to my phone and it's really irritating (and dangerous). It doesn't happen often though, it's really random. Hopefully the Genius will offer a replacement even if I can't replicate the issue.

I HUNGER
This started happening to me after the latest update to ios 5 on my 4s, BUT it definitely seems to be a hardware problem. If i just slightly brush the volume down button (not push it) it wants to increase the volume to max. I did a software restart, hard restart and restored my phone, but didn't help. The only thing I haven't tried is a restore and set up as new phone. That's a bit of a PITA so I will try that later.

To the person who is having trouble getting the icon of screen: Push the volume down button, then up button immediately and that should stop it going bonkers and will allow the icon to disappear after a second or two.

I will take mine into Apple in the new year as I'm travelling for the next 3 weeks.

It's just odd that it started after I did the latest update.

My launch day 64GB black 4s was doing this too. The volume meter would randomly shoot up to the maximum level. It would persist even immediately after frantically turning the volume down. Really a hazard while on the treadmill with earbuds.

I could also initiate the volume maxout by lightly touching (not pressing) the volume down button. Yesterday, I made a genius bar appointment and the employee swapped my phone for a new one. Everything's great so far and incidentally, my home button feels more sturdy. I never thought that the home button on my old device was loose per say, but there's definitely a difference.

So, in sum, it's most likely a hardware issue that Apple deems merits a new device. No more spazzing out on the treadmill.

I am experiencing this too. When I go into an app or just on them homescreen, I just get full blast volume. Very annoying. I hope that apple fixes it, it is probably a software problem because I completely restored my phone for other reasons but it still happens. Other than that, it could be an odd hardware defect that some phones have.
