Evidence? Now you've ruined all the fun! This is supposed to be a rumours site.
1) It's likely that your refurb product will *not* come with Leopard. You might get lucky if you wait awhile.
2) Typically the promo codes are restricted to new regular price products only, meaning that refurbs and education purchases will not allow the discount.

1) It is my understanding that anything purchased within 14 days of the release of a new OS qualifies to upgrade to the new OS free of charge (they do this to keep sales from going in the toilet for the two weeks prior to the new release).
2) Promo codes DO work on refurbs if you find yourself a kind-hearted Apple Authorized Business Agent who has spare codes to share. These are valid in the Biz Agent store and NOT the ed store.

As to the second point, a coupon on a refurb might work in the Biz Agent store, but we don't all have access to Biz Agent coupons. And really, how many of us routinely shop in the Biz Agent store?
Perhaps it's time to start shopping there - anyone can. It might also be a good time to meet your local business agent. You can find one near you by going to agents dot apple dot com.
