thanks micJ i used make MKV to get the rip, i dont want to shrink it in any way which is why i didnt handbreak it. Hope there is a setting in make MKV to get an mpeg4 ?

No, MakeMKV only can take the original codec, whatever it is, and place it in the mkv container. Changing a mpeg2 to and mp4 is transcoding which is what Handbrake does. I would really recommend you Handbrake a small part of it, using High Profile preset, and compare it to the original. You might be surprised at how well they compare.

I will start off with the High Profile CQ @20 I am sure it will be fine.

Believe me, I wish I could do what you wanted to do. I have about 200 mpeg2's that I would love to just move into the mp4 container. Just as a side note, for doing what you wanted, I think mp4tools is better because it will automatically create the AAC stereo audio track and place an h.264 into an mp4 container.
 
Ha ha I actually tried the MP4tools and struck out there as well with this very same mpeg2 file...
got an error after all the muxing. i followed the settings someone suggested from (screen caps) and no success. I am guessing its also because i used an mpeg2 file? Regardless that program seemed alot more complex than subler to me.

Not really more complex if you consider what you have to do to get the additional AAC audio track created and into Subler. And yes, error was due to it being mpeg2. Use Media Inspector to check the codec of the file before trying to change the container. But contrary to what a lot of people have been saying, I have never run into a dvd that isn't mpeg2. Torrent downloads are often h.264 (they have compressed them for downloading, so you are not gaining anything over doing it yourself with HB) and most blurays are h.264.
