I think people need a reminder and to actually watch the 2007 iPhone keynote and be reminded that Apple created the smartphone as we know it today.

They also need to be reminded by the words of Steve Jobs himself about what the iPhone's technologies meant to Apple.



Why doesn't Apple have these problems with Microsoft or Blackberry. WebOS was pretty slick, and managed not to steal from Apple. Maybe because those companies have vastly more experience with designing an OS and don't need to steal from Apple to create new products.

Do you understand that Motorola has garbage for software patents and many of their hardware patents are FRAND.

Maybe you should do some research on what happens when companies try and extort using FRAND.

Yeah, and I remember in 07 scratching my head saying "okay so how is this different then my BB?" along with everyone else on the forums.

The FRAND defense make you as slimy as the company claiming it. "oh there is a thousand ways to make 3G work but let's rip off the company that invented it and just claim FRAND". You honestly think that's ok? This isn't over just using 3G it's how it was done, hence the lawsuit.

Samsung violated 4 of Apple's patents and as a natural response, Apple sued Samsung. How is that wrong?

Actual infringement hasn't been determined yet.

And Apple's patents are completely vaild. Otherwise, the would have been rejected.

Any other company who actually cares about their product would do the same.

Any company that cares about its product would get it out of beta.

The idea that the Google search box on the Samsung homescreen is the same thing as Siri, is ridiculous.

Judge Koh's ruling notes that she depended on Apple's claim that customers buy the iPhone 4S because of Siri's unified search (not because it talks) and thus the Google search box takes sales away:

"Samsung insists that “the Galaxy Nexus doesn’t compete on Siri.” Tr. at 111:4. Samsung responds that the Siri feature on the iPhone 4S and the Quick Search Box on the Galaxy Nexus are not comparable features in the eyes of consumers, and that Apple has failed to adduce specific evidence that the unified search functionality claimed by the ’604 Patent, as opposed to the intelligent voice-response feature of Siri, is the real driver of consumer demand."

Samsung’s criticism of the probative weight of Apple’s consumer survey evidence on Siri is well taken, but the Court nonetheless finds the evidence to be persuasive circumstantial evidence. While direct evidence of Galaxy Nexus customers’ feature preferences would certainly be even more compelling, Apple’s survey evidence of its own customers is still relevant to the Court’s determination of what features drive consumer demand for either the iPhone or the Galaxy Nexus." - Koh

The court found that each of the four asserted Apple patents is likely infringed and valid, but only issued an injunction for infringement of the '604 patent. Judge Koh reasoned that unlike the other three patents, the '604 patent covered the highly valued unified search feature of Siri that contributed greatly to consumer demand for the iPhone 4S. Moreover, the court held that Android's infringing "Quick Search Box" feature was touted by Google as a "core user feature on Android" and, therefore, was also a key selling point for the Galaxy Nexus. From there the judge concluded that Apple would suffer irreparable harm in the form of significant lost market share if sales of the competitive Galaxy Nexus, and its unified search capabilities, continued:

Riiiiighhhttt. Blackberry totally beat Apple to the punch and that is why Blackberry is in great shape today.

And FRAND patents work in Motorola's favor. Apple can't "rip off" a FRAND patent. They will be required to license reasonably and pay Motorola a royalty.

The problem is Motorola wants to extort, not license. The cellular industry is standards based when it comes to connectivity, which ensures phones actually work.

Google and Motorola can engineer software hundreds of ways so they aren't stealing from Apple. Apple can't engineer their own connectivity standards.

Its fine to want to protect your investment I understand that. But to sue everyone while you are stealing a hundred ideas yourself is a little silly...

I don't know the answer to this question, which is why I ask. Do we know that Apple didn't legitimately get the licensing necessary for these patents they were/are using?

That's because Apple doesn't create anything. They're masters at repackaging and spinning it like they just re-invented the wheel. How many people do you think are out there that actually believe Apple invented Siri? And Apples biggest feature they push is Siri. It's shameful.
But the tides have already turned for the better. The massive success of the S2 was the real starting point to people actually seeing the light. And now the S3 has taken it to a whole new level. And Apple knows exactly the threat that Google is, especially partnered with Samsung, the biggest Smartphone Seller IN THE WORLD. Here's what Apple said when they desperately try to ban the S3:

I agree with you, I too have no doubt in my mind that someone will pick up an S3 and think they are buying an iPhone. Never mind the dominating size, design, performance and that SAMSUNG name on the device. :rolleyes:

I didn't say BB was better I just said a already had a phone that did everything the iPhone did.

Extort? What are you on about? Why not actually read the six patents Apple is infringing on? Then post back about this FRAND and standards nonsense.

So what is the injunction actually doing to google/Samsung? I still see the alaxy (galaxy*. Ugh just another example of the ios keyboard missing keys) nexus for sale on the google play website...

The s3 looks terrible

Its actually quite nice looking. Saw a demo in person yesterday and it isnt as big as i thought it was going to be. I didnt care for the Pebble Blue color though. Looks more purple than Blue. Other than that, it is a great looking phone imo. White looks great I think it is nicer looking than the iP4S.

Google and Samsung together are a sleeping giant with patents, especially now google has motorola, who have been in this business for a lot longer than apple, they own 1000s of patents, as has been said already Neil Armstrong on the moon back in 1969 said those famous words over a motorola radio, and Samsung own the 3G patent, so if Apple thinks they can outdo that, they are on a different planet!!, i really hope Google/Samsung block the next iPhone, that would shut apple up!!;)

What are you going to do about the icons? And do we really care what kind of box it comes in? How many even save those? Should Nike sue Reebok because they use the same shaped box and put their shoes in it the same way?
Apple is the only one that uses that connector. Everyone else uses a micro plug. So can everybody sue Apple when they switch to it?


Whaaaaa...you stole my box, slide to unlock and use icons. Hey wouldnt it be cool if they all sued each other and NO phones can be made or delivered? :rolleyes:

You can spin it anyway you like. But the truth is, Samsung has copied apple.
