I think the latter. As far as I know, that's still forbidden here in Belgium to sell a phone locked to a certain operator. You're paying the full price in any case, so they have to let you choose your own operator.

To be sure, I can check it out tomorrow if it still matters.

Just for reference of whoever finds this thread on Google:
My friend bought for me an iPhone 3GS in Belgium some time in Nov-Dec 2009 (don't remember the precise date), works perfectly in a different countries (in EU and out of EU) and completely different operators.
 
What is the difference ???

Jailbreak means that you can install whatever apps you want on it; you aren't just limited to Apple's AppStore.

Unlock means that you can use it on any carrier that uses SIM cards; for example if you are in the US you aren't stuck to just AT&T.

I have a question though, if you buy an unlocked iPhone from Italy or Belgium or Hong Kong, when you sync it with iTunes in the US, will it become re-locked?

I'd like very much to buy a legally-unlocked iPhone but don't want to worry about the possibility of it becoming re-locked.

Mine (bought in Belgium, activated and used in another country) continues to be unlocked and usable.

That's the whole point of *official* unlocking. If it's officially unlocked, then it's unlocked everywhere and you can use whichever operator you like.

Just one last question, if I bought an officially unlocked iPhone and used it with AT&T, I would still be able to take it to another country, pop in another SIM and be on my merry way?

Yes you can update and at the end iTunes will check with the server and retain the unlock state.

You can use any sim, only the respective APN would need to be entered, to access the internet.
