Yeah I do understand that but what I'm saying is that Apple got their kickback when I bought my 3GS on PAYG (which was a valid upgrade path).

My PAYG sim is probably in a landfill site now. They're not going to get anything else off me in respect of the PAYG iPhone no matter how long they make me wait!

I guess its a case of possibility rather than actuality

If they get no more money from you between now and when the 12 months is up is not the point.

Yes, I appreciate that too but I'm just saying it's irritating that the upgrade path they provide means you get penalised when it comes to unlocking the phone.

There needs to be a "proper" sim free option made available. I'd rather just shell out the money upfront than be locked into some petty O2 contract.

If they let you do it any time, people would buy them up in bulk, unlock them and sell them.

I thought making pay and go users pay for 12 months web and wifi upfront was the method for disincentivising people from unlocking and selling on (given that there are other methods to unlock).

Ah, well...

I just received my "denial" text from O2.

Meh...

If they don't unlock it when I leave them in January, I will!

Yes. That's right.

I've dashed off a terse email requesting their reason for denying the unlock to a Pay-Monthly customer. Of course, I know the reason but I'll be interested in the actual wording of their reply. Considering that they encouraged this method of upgrade, with no mention of any "penalties" or contract complications, it might be worth a quick word with trading standards.

I'll also be interested to know if they'll be unlocking the phone that I sold when I bought the 3GS, since it now belongs to a PAYG customer who's only had it for 5 months. That'll be a topic for a later email, though.

In exactly the same position as you. I completed my unlock request form only 30 minutes or so ago....

Filled the form but i seem to have been denied. Bought the phone PAYG but never used the PAYG sim and have been using my 2yr+ old Simplicity SIM. Meh...i'll just use the alternative method when i'm ready to dump it, im unlikely to be using an iPhone in 6 months anyway

not had that message yet (24 hours give or take) so fingers crossed.

Since I'm not actually with O2 anymore there's no way for me to unlock my 2G.

Siiigh. I'll be phoning them when I'm home over Christmas and making them unlock it. I bought it 2nd hand after its first owner paid off the contract and switched to a Blackberry so they've had their money.

Basically it has been highlighted to them, and they are aware of it, that currently on their system if your pay&go contract is over a year old, but your iphone shows up as being only say 2 months old due to a swap out they will not unlock.

I was told by Customer Services that there is a meeting going on today about that.

As my contract started on the 4th december. My iphone was swapped on the 15 december as it was faulty and so the O2 system says I cannot unlock until the 15th. Currently my iphone has a white screen and I have a genius appointment for this friday. So I guess that when I activate the refurbished iphone it will pop up as being only on their network for a few weeks. when I come to try to unlock it.

Sorry if this has been asked already - I can see that some people have had the text saying that their phone can't be unlocked (PAYG and less than a year), but has any one had their confirmation text on pay monthly or had o2 unlock their phone yet?

I filled in the form first thing yesterday morning and not had any kind of confirmation or acknowledgement.

I know that o2 are going to be swamped with requests, but thought I'd ask.

Also, anyone got any suggestions on which network to go with? I'm looking at t-mobile solo 20 - spoke to them this morning and they say that the unlimited internet includes tethering, so £20 a mth for unlimited texts, internet and 600 mins seems like a good deal.

I got an email confirming I will be unlocked, but only after I had a previous email saying I couldn't and I had replied asking them to check out their own website.

i'm still not 100% sure on this "unlock" for pay monthly...

Your iPhone can be unlocked at anytime free of charge. If you unlock your handset and place a non-O2 sim into it, you will still have to honour the remainder of the minimum term on your contract.

so does this mean, for example, if you have 3 months of your minimum 18 months contract left and you want to use a non-O2 sim card (say to go abroad or something), you have to first pay off the 3 months of your contract before you can use the non-O2 sim?

Hey All,

I have had my iPhone 3G for nearly 2 months now but another family member of mine used to own the phone before me and they gave me the phone when they finished there 12 month contract on O2, and obviously it is locked to O2. Would I be able to fill out the online form to request the unlock myself or will I have to get my other family member who was the original owner of the phone to fill it out instead because his name was on the original O2 contract?

I only need it unlocking so I can use it with my Orange pay monthly sim card and I tried the method posted on here where you hook it up into iTunes, sync with the iPhone and iTunes downloads the new Orange Carrier settings which allows for an Orange sim card, but for me it did not work & never received the carrier settings through iTunes I tried it loads of times! :(

Thanks - Liam

No. You just have to pay the last 3 monthly payments as and when they are due.

*Waiting impatiently to find out whether O2 will unlock his 'upgrade' 3GS, purchased on PAYG at their recommendation but always used on contract*

Surely they have to unlock... but I'm prepared to kick and scream!
Of course they should.
Bear in mind though that if you are still within the "contract period" of 18 months you will still have to pay for the remaining months.
If you are "out of contact period" then you are good to go. :D

But I guess you know that.

As the PAYG iPhone was sold to be used as a PAYG phone, I would be very surprised if it was anything but 12 months from when you bought the 3GS.
That's debatable - in my case the O2 store manager said because I had a monthly contract already I could put my SIM in the 3GS and therefore not pay the otherwise mandatory £10 to top up the PAYG SIM. So as far as the O2 shop were concerned at the time of sale, it was not sold for PAYG use, but for use with an existing contract SIM.

Those of you who got a 'No' to the unlock, how long was that from the initial request? It's been 3 days now with nothing from O2

My No was in about 12 hours.

Also I found out that if you have had you iphone swapped under warranty currently the answer will be NO to unlocking even if you have done your 12 months on pay&go.

According to Customer Services they are having an internal meeting about this today.

Precisely. The manager in the Apple store in Regent street was instructing all his people to activate the 'PAYG' phones with the customer's monthly contract sim and not to even open the PAYG sim. This had been agreed with O2.

O2 themselves were suggesting this route as an option to monthly customers who wanted a 3GS.

That advice is still live on this page:

http://shop.o2.co.uk/update/upgrade.html

"Option 2 - purchase the iPhone 3GS on Pay & Go.
You can give your existing iPhone 3G to someone you know.

Pay Monthly customers can place existing iPhone 3G sim card into the iPhone 3GS and receive all the latest functionality. Customers must continue to pay for their existing Pay Monthly tariff."
