I want to thank you all for your input and suggestions.

Just to clear a couple things up, a few of you made it sound like I purposefully ignored Paypal's rules and still expected to be reimbursed, but actually this was just me being unaware of the rules and terms of the seller protection policy (my own stupidity).

Also, as soon as the funds were transfered via Paypal, I immediately transferred them into my bank account-- in fact, it's all still there in my possession (minus the $101 Paypal fee). The problem came later when the "buyer" filed the unauthorized charge and had Paypal pay him back the money he lost, leaving me with a negative paypal account balance. Paypal says if I don't pay them back, they will send a collection agency to my house.

Paypal and Ebay have officially closed their investigations and the auction and item # have basically been wiped from the system, like nothing ever happened. I did file a report with IC3.gov, which is an internet crime center so I'm waiting to hear back from them.

I also plan on going down to the apple store and letting them know that my serial # has been stolen. There is still a year of Applecare left on it and its still under my name and address. I hope apple will be willing to call me or the police if its ever turned in to them.

I recommend you look up the laws on collection agencies and go to http://www.paypalsucks.com That web sight does help with the collection laws.
You might still be in the right and they can not legally demand money from you though a collection agency.

Also check on the laws dealing with collection agency so you know what they can and can not legally do. A lot of them will break the law knowing that most people do not know their rights.

What bother me about pay pal is it when some one breaks into some else account and they file an unauthorized charge paypal will go to the other person for the money even though it is paypal's system that screwed up. Plus they seem not to want to do any real work in solving the problem. They do not care as long as they get the money. Some how I do not think they bother looking to see if this guy had a history of this but instead just stole it.

It is possible that you made a fault with paypall but it is obvious that the guy who owns the paying account also has made some sort of fault. Maybe the account was created with a stolen credit card or someone hacked a paypallaccount to buy your goods. I for myself would consider not to pay the money back to paypall, the fact that you were able to transfer the money to your bank account is a proof that they agree with the transaction. It should be better that they build in a system to put large sums on hold until they are completely sure the transaction is ok.

i dont trust either paypal or ebay
when i get money on my account, i directly transfer it to my band account. once that done, i ship or whatever it is

I really hate to tell you this, but Paypal has absolutely no problem with taking the money back out of your bank account. So don't think you're safe if you withdrawal it.


Sorry to hear about the loss, Paypal can suck sometimes all the time. Same thing happened to me too, granted it was $15 which pales in comparison to what you lost, but still, it pisses me off that they hold us responsible because their account and credit card security absolutely sucks.

yeah but if pal pay does that you can always tell your bank you did not authorize it and they will pull it back.

Here we go again, let's blame ebay and paypal when honestly, people aren't aware of the rules they have to follow when selling products- offline or online.

If you offer pickup, ONLY accept cash. If you accept credit card payments.. then you need a physical card terminal.. so you can print a receipt and capture the card holder's signature. You do that at every retail store, correct?

So a PayPal transaction is an online transaction.. where the card/customer is not physically present. How does the merchant company/credit card company confirm then, that the customer DID get the product? By shipping the product.. and issuing signature confirmation.. so they have proof in the form of a signature.

Your money would have been gone with any other merchant provider such as Google Checkout, Authorize.net, etc. For heaven's sake.. if you are going to be selling something expensive.. learn the basic rules of e-commerce. PayPal, and other merchant companies put these guides up but obviously no one bothers to read them! I hope you get your computer back.

Ah, just read this post of yours. I believe this issue will be sorted out once ebay figures that this guy has scammed others as well. Just takes a while for their investigations to be complete.. I've been through something similar to this.. and they pretty much caught the person (he opened multiple ebay/paypal accounts using fake ids.. scamming buyers.. etc. ) It just takes really long to catch someone like that though.

see this is where it is a good idea to talk to a lawyer and to learn the credit laws. I know if requested the collection agency has to prove the debt is valid.

Of course what this thread also does - it serves to give instructions to peeps on how to rip off ebay sellers and seemingly get away with it. :eek:


I was ripped off from a seller on ebay for a powermac G5. I will never buy or sell anything of major value on ebay ever again.

damn, sorry to hear your news.

to all readers,

- if you are going to arrange a pick-up, pay by CASH only, or at least a bank guaranteed cheque.

- if you sell on ebay, get your and the buyer's addresses confirmed by paypal.

- only sell your stuff once you have got your cash! ie. do cash transfer by bank.

Oh good lord. If the buyer is COLLECTING, do not offer Paypal as a payment method! Get the money up front!

]In fact, just don't offer Paypal ever! I hate that POS service with a passion, and your situation perfectly illustrates why. It just makes money more complicated.
