I'm a little skeptical of this thread and it's OP.

I mean, this is the "free" internet, and anyone can post untrue, unsubstantiated claims. Knowing Dave of Mac Vid Cards for over a decade and a half, I can say, sometimes he's been known to fall behind on orders and fail to communicate properly when "real life" issues such as health have befallen him.

However, I also know that Dave seems to attract "utter nutters" like no one else I know. A lot of the time when I've seen public posts on the internet claiming that MVC has stolen or defrauded someone, when pressed to offer any proof, the OP conveniently disappears.

Also, people like to take MVC work product( ROMs ) and figure out how to flash them to cards that they then sell on eBay or some other place, while launching a disinformation campaign against MVC, in order to try and bolster their own sales.

I'm not saying the OP is lying, their may have been some mix up, and poor communication/poor customer service. Tho it would mean more coming from a regular poster here at MR, so, as I say, I'm skeptical.

To wit, I feel this thread should be removed as slander, unless the OP returns to offer some proof.

I had a similar experience with MVC. I'm not going to pile on anybody in this forum, but what happened to me was pretty clear-cut: I bought a flashed card from the company website, then, although the card worked perfectly, returned it, being very careful to pack it and ship it properly. Fortunately, I also insured it. I waited to hear from MVC that they had received it, meanwhile finding out that the USPS had tried, but couldn't actually contact anyone at the destination. Nobody home [at the LA apartment house where MVC lives]. So I waited. I sent emails, I sent a letter to the apartment. Nada. I received no response whatever. Finally I gave up and filed an insurance claim, which was honored relatively quickly. So why these sort of screwups keep happening, I have no idea, but it isn't an acceptable way of doing business. I can't recommend them, and I won't do business with them again. So other posters can call my story slander all they want, but it happened to me. I can supply evidence from the USPS.

Interesting did you see somewhere on there site or through communications that you can return an Item which is working perfectly?
Edit:
Yes there is 60 days warranty and 10% restocking fee on a working card:
HOW DOES THE 60 DAY WARRANTY WORK?
In the event that your graphics card is dead on arrival or develops some issue shortly after purchase feel free to send an email describing your issue. Provide as much detail as you can (Mac Pro Model, version of OSX, software being used, monitors being used, power supplies being used, etc.) to help with the trouble shooting process. In the event your item is not usable as is it can be returned to MacVidCards for a replacement or a refund.

Please provide a tracking number for the return shipment. Replacements can be cross-shipped on receipt of your tracking number. Refunds are sent on receipt of the return shipment and may take several days to process depending on your bank/method of payment.

Be aware, returning a card that is not damaged or defective is subject to a 10% restocking fee.

I don't recall seeing anything about returning an item, but as you noted, if there is a restocking fee for a functioning card, that just begs the question: Why didn't they request the fee from me? My conclusion is that he, or they, simply weren't interested in responding to anybody about anything. They seem to want as little as possible to do with their customers. I presume that the restocking fee would be deducted from a refund, right? Well, there was no refund. There was nothing. So do you, also, think I am slandering a company not present to defend him/itsself? I have reported what happened in my transaction with MVC. Period.

I bought a card from them that allowed me to use Metal on the Mac Pro when that was a requirement. The card was buggy and gave me pink artifacts all over. I emailed them with a video showing the artifacts and was promised an exchange but when I emailed to do this, received no reply. I tried emailing again and again for about a year before I gave up. Screw that company.
