Exactly. But they can't say "I refuse to sell you this because you don't deserve one.". If they worked on that basis, their stockroom would still be full.

I would so love for this story to be true, and I guess not deserving one is form of discrimination.

Maybe your GPA wasn't good enough for him. He's most likely the Harvard of Apple Store Employees.

Go back to the store and look for dumb Apple employee. Most will be content with an average GPA from a community college.

I'm at a top 20 with a above a 3.7. Maybe I go to a school he was rejected from? Only logical reason I can think of was me taking a class in based on learning MS Office and how to program on a PC.

...they are very low on supply and he will only sell to those at his discretion (is that allowed?)

No. Apple's corporately enforced policy is first come, first serve. Believing that a store manager would knowingly allow/encourage discrimination is nonsense. If this truly did happen, both the representative you talked to and the supervisor would be quickly let go, provided the regional manager is informed (or perhaps someone a bit higher up )

He said I had an iPod Touch, an iPhone, and a MBP. I think he didnt sell it to me because he was trying to save me money.

You would not be top 20 with a 3.7.
Heck, I have a few friends who have above 4.0's.

Are you a handsome lad? Perhaps he was looking for a little fun after work in exchange for a sale?

In the same way a restaurant can deny you service, a retail store can choose not to sell you something.

I do call BS on this story, but unless it was some obvious descrimination (based on age, sex, orientation, or race), it's perfectly legal for them to say they won't sell you something. Whether or not Apple corporate would be happy about this is a completely different story.
