If AT&T does its periodic scans and notices theres an iphone with no data on your account they might automaticly add the $15 data plan on it.

just use it mate, yeah its wrong but the big companies will not care about your phone, it is pocket change for them. yeah its immoral but you aren't bothered, and neither are a lot of people, me included.

you wont get prosecuted for fraud as you didn't commit fraud.

if the imei number is blocked just use it as an ipod touch, its better than nothing! there used to be a way with 1.1.4 where you could change the imei number. no idea if you can still do this but you could look into it. i think it was ziphone you could do this with.

It's his legal obligation to phone and report it. He can in reality do what he wants, but hopefully won't bitch if he gets slapped with a felony charge.

Actually, that isn't necessarily true. He would have to read in the AMEX insurance paperwork he signed. If there is a "responsibility to return if found" section, he would be technically obligated to. Otherwise, he isn't.
 
well my sister just told us that it disappeared ( shes in college) so we didnt know if it was lost or stolen. We kept calling/texting it, had at&t try to find it, and then reported it stolen.
The phone isnt very old though, and it works perfectly. and i still want to use itt!! lol. besides, if amex is just gonna dispose it, might as well put it to good use right?;)

Would I have to re-activate it and jailbreak it so they dont find out? could someone tell me how to do this?

If it was reported stolen to AT&T, it will not work on their network. I'm not sure if they share IMEI numbers for phones that were reported stolen with other networks, but if they don't you could potentially use it on T-Mobile.

Get your assumptions straight before posting them as facts.

If AMEX has logged the IMEI number then the phone won't work at all on any carrier. Coz all carriers in the country use the same blacklist of IMEI numbers. This is IF the IMEI has been logged. No harm in using to check. If it works fine. Else it can be used as an itouch!

The phone WAS genuinely lost/stolen. It wasnt returned to us until now. What would be the purpose of faking something like that if we're not even sure if its gonna work?!?!? ( As professionals, my parents would never go for something like that. and my sister is def not smart enough to plan something like what. and she really has no reason to. She doesnt like me THAT much.)
Regardless I GET now that its fraud. and maybe my parents will make us give it back ( theyre not here right now, but when they get back we'll see what happens).

But my question was is it possible to use and how. so if anyone could answer that, i would greatly appreciate it.

Just put in your ATT sim card and use it.PERIOD. no need to jailbreak or unlock. and don't worry about being charged with multiple felonies or misdemeanors, what a joke some of the fools on this forum are :D

Completely agree. Nothing is going to happen. I know a few guys that have had phones from craigslist that were stolen. They just used it and nothing happened. These posters in here i just think are jealous and i cant think of why that would be. What do you fools care what he does with the phone?

Just use it, it will be fine but if your worried, just sell it and that person can enjoy with no worry.

He asked if it would work and some just want to tell him about how wrong he is for thinking his phone was stolen and some time later somebody actually returned it which he wasnt expecting. Who cares what you think, either answer the question or not.

What matters is I consider myself a moral person. I don't jailbreak to steal apps and don't break laws (other than speeding too often). Keeping or converting property that does not belong to you is stealing.

And I am not afraid to suggest to others that they do the right thing. The world is full of people doing the wrong things.

Generally, the moderators here do not condone piracy and stealing. Hopefully this thread will go poof.

And I have as much right to comment on this thread as you have the right to tell me not to comment.
 
I don't understand why this is even up for debate. Obviously many of the replies in this thread are coming from children who don't understand that your actions have consequences. If AMEX finds out either directly or indirectly they could retroactively deny your claim and you could be liable for both the replacement cost of the iPhone and for your actions should they choose to pursue legal recourse. If you have any wits about you you'll contact AMEX and the authorities before you do anything that could result in claims against you.

He thought HIS was stolen and sometime later, he was returned....luckily i might add. If that is stealing to youthen i dont know what to say.
Nothing wrong with having morals but if you ask me, i think Apple is stealing from people everytime they ask us to pony up a fee to get the 5 extra Apps that i didnt get with my first gen iPod that they gave to everybody else for free and then want me to pay 10 bucks to get 2.0 & 3.0 updates that everybody else is getting for free.

I dont feel sorry for Apple at all if he luckily got his phone back. They want to make more money, release the phone to every carrier and they will but dont charge bulls*** fees for some and not others.

If this guy is asked to pay a fee for his phone then great, he can but if they dont, ....again, it isnt like he stole it from somebody. He didnt know he was going to get it back.

Just saying i dont feel sorry for them. It isnt an arguement on my part. Am i stealing since i dont have AT&T but use an iPhone? The rest of the world gets them unlocked and T-mobile dont seem to care that im using it either.

Once an insurance replacement is made, the original item (if recovered or found) belongs to the insurance company. OP wants to convert it to her own use knowing it belongs to insurance company.

if you really go to jail on a felony charge for this, you have got to be an idiot. only 13% of criminals ever get caught, and most of them are for the big stuff like murder. its an ethics question, not a legal question (unless you are very unlucky or stupid).
