Exactly. Apple has not sued the others because they haven't copied Apple. Apple has sued (and won) Samsung because they did copy Apple. That's the point. Apple is not stifling competition in the marketplace, they're stifling those who copy them.

Apple sued Nokia

Evidently you're blinded by your myopic view of the industry. Has Apple sued Microsoft? Has Apple sued RIM? Had Apple sued Palm? Apple has in fact licensed its patents to Microsoft. How is that stifling competition?

It is not coincidental that Apple is pursuing Samsung. Samsung has blatantly copied Apple and this was proven in a billion dollar lawsuit, with a unanimous verdict reached by a jury.

The message is clear. Steal Apple's work and you'll get sued. Innovate and you're welcome into the market. Once Android differentiates itself from iOS, they'll be welcome to join Microsoft and RIM in competing with Apple.

In a court in Tokyo last week, the case got thrown out as they said they did not copy Apple. Apple isnt suing anyone else because Samsung is their biggest threat and they would be hypocrites to sue Microsoft. If not for them, Apple doesnt exist today.

I mean seriously....they were given a patent for a rectangular phone with rounded corners? Yeah that isnt standard  Wonder who had the patent on flip phones back in the day? They could of scored an easy billion

Maybe car makers should start suing each other. Just a ridiculous lawsuit and as usual, the US has got to get their patent system as well as other things straitened out.

And Android is very different from iOS. Not even close to being the same.

Interestingly, the judge for this lawsuit is Lucy Koh again.

Apple v. Samsung - at Justia Dockets

Apple's still using the lawyers from mofo.com. Samsung's using different ones at gibsondunn.com.

Both sides applied for more time to get ready (docket entry 259 on that page).

Looks like they'll be spending the next five months debating patent claims construction.

Android or iPhone makes no difference. Even in "stand-by", phones drain batteries just trying to stay connected to the cellular network. That is the biggest source of drain. The less the signal strength, the more the drain too. iPhone isn't immune to this, no phone OS is, as it is completely out of the hands of the OS, and into the hands of the radio chipset and carrier.

You're just making stuff up at this point, you obviously have no clue what you're talking about. I love my iPhone as much as the next guy, but I'm not going to sit here and pretend it's some kind of god phone that can break the laws of physics.

And heck, the battery drains hella fast on my iPhone 4S, not because of some flaw, but because I play IB II and Catan a lot on it.

I never said iOS was immune. I'm saying it's less of a problem. I know because I have one. I've also had an Android, and I have many friends and family who have both. I've had two Windows machines and one MacBook. You cannot simply "not know what you're talking about" in this situation. You talk through experience. Experience I've had. You may not like it, but it's pretty accurate. If you want to ignore it, that's your prerogative. Also, I've stated many times that the 4S is the exception. I'm not going to type it again.

Are you some sort of OS programmer to be so sure of yourself?

My iPhone 4S is actually better than my 3GS.

Your anecdotal data is pretty accurate only for yourself. It's not evidence that the iPhone has better battery life than the rest of 'em. In the end, they are all pretty much equal in terms of battery life, the OS makes no difference.

No, just some guy who has cell phones for the last 15 years and can read quite a few benchmarks online to see that the iPhone is not sitting at the top of the charts all the time. There's no need to pretend to make myself happy with my purchase, it doesn't have to have the best battery life.

It's ok to admit that there might be better devices out there. It doesn't change what you bought.

Really? My coworker said the exact opposite in regards to the two model phones. I wonder who's right? You seem to be sure you are, so there is no arguing with that. If it helps you sleep at night, I'll just agree that you are.

Apparently the new Galaxy is better, because the battery is much bigger. Yet someone on here said their phone dies within half a day. Mmm...I wonder why that might be? Perhaps he didn't kill off his wifi, Bluetooth, any unused programs that might be running in the background, notifications, etc. Must be used to his old iPhone where that wouldn't have made a difference. Ah well, iOS sucks up just as much battery according to you, so I guess he'll figure it out on his own.

By the way, I don't own an iPhone. I do purchase Apple products because they are known to have longer battery lives. I was pretty sure that was common knowledge by most, but it appears I'm wrong. Either that, or they really don't. From my extensive experience with them, they do though. Hence why I changed to them. If you want to cling to benchmark tests, then by all means, go for it. I'm more of an experience learner myself.

It's more that they really don't. Apple doesn't have pixie dust. They are within industry standards as far as battery life goes.

My iPhone can last half day like it can last 2 full days. Depends on what I do with it, same with any other devices. Frankly, Smartphone battery life is appalling compared to every old dumb feature phone I've owned before by Sony, Nokia, etc, and they didn't have the battery technology we have today.

I have a "dumb phone" at the moment that actually dies before my wife's 4S. But I am inclined to agree with you, smartphones do have a bad track record with battery life. I was extremely impressed with my iPad though. When Apple says it will last ten hours, they really mean that. This thing lasts a good long while before it needs to be charged. Watching movies, surfing the net, making a call on Skype, doesn't matter at all it seems. The same ten hours applies no matter what I do to it. Even when people were saying the jump to iOS 5 significantly reduced the battery life, I haven't noticed a drop at all. That to me makes me believe pixie dust might have been used.
