honestly, how long has the iphone been out? i think they have had enough time to get this working dont you guys?

Yes, the amount is silly...but i think the point of it isnt. Apple promoted the iphone as capable of MMS, sending pics...not emailing, but sending pics to a phone number.

They falsely advertised it. They should be sued...but as i said, they amount is just silly. It almost makes this lawsuit ridiculous.

They didn't falsely advertise it at all. My iPhone is perfectly capable of MMS. It is entirely down to AT&T that MMS doesn't work in the US.
 
September 22nd is more than a week away... just FYI.

You would think that by now that the one thing positive about not having MMS would be that people would have learned when summer ends.

For the posters that believe that people have been fooled into thinking they'd have MMS by false advertising, well I think that anyone who thought that probably would the ones on here asking about the second speaker and they just might be better off not owning one in the first place. :) j/k

if AT&T were too actually loose (highly unlikely) considering It's Sept 22nd official end, Also Business make promises to customers all the time and change release dates they should all be sued. :rolleyes: If they loose who do you really think pays? us and the same people that hired the idiot lawyer. AT&T will just raises the rates here and there and they will get 5 billion and then some. they are not going to pay no matter what it's big business 101 lol.

The 3.0 software already came out, so it seems that we are waiting for nothing at this point.

The 3.0 software already came out, so it seems that we are waiting for nothing at this point.

AT&T and Apple announced WWDC conference in early June that for AT&T it would be late summer. summer ends Sept 22nd and hopefully the MMS threads along with it doubt it though. :rolleyes: and there is no mention of extra cost MMS is included in what ever SMS package you have. tethering will be extra.

I know that, but that is on their website as we speak. Regardless of what was said then, I just read that.

What you read does not contradict AT&T's previous statements. I think you are interpreting this as saying that immediately upon the 3.0 upgrade AT&T would make MMS available. They qualified it, however, with the phrase "later this summer." That it happens later this summer does not make it not part of the 3.0 firmware.

I know that. I am just saying that what they are posting on their website is misleading. It would make people think that upon the release of 3.0, MMS will be available to use.

Submitted in a US district court for southern Illinois, on behalf of Tim Meeker and other unnamed plaintiffs, the suit accuses Apple and AT&T of having "misrepresented and/or concealed, suppressed, or omitted material facts as to the iPhone having MMS functionality." Representing Meeker's party is the lawfirm of Rosenblum, Schwartz, Rogers, Glass, P.C..

Apple first announced that MMS would be an option for iPhones when it unveiled the iPhone 3.0 firmware. At June's WWDC event however, the company also warned that the feature would not be available from AT&T until late summer. That fact has been left out of both companies' marketing efforts, lawyers charge, resulting in "deception, fraud, false pretense, false promise, misrepresentation and unfair practices."

The lawsuit accuses both companies of misrepresenting the availability of MMS on the iPhone. According to a report by TG Daily, the suit points out that both companies aggressively promoted the MMS features of iPhone OS 3.0 and the iPhone 3GS using advertising on TV, radio, newspapers, direct mailers, and on the Internet. The suit is expected to represent at least 10,000 people for the class action.

Finally, the complaint points out that the fact that AT&T doesn't support MMS is relayed to customers in small, barely readable print on a Web site saying that "MMS support from AT&T is coming by late summer. "

They misrepresented the MMS feature on their Iphone....doesnt matter if its Apples fault or ATT fault. Apple promoted as it was going to be released at with 3.0. People are pissed cause instead of stating that in the beginning, they went ahead and continue to promote it as a MMS capable without making sure ATT was ready for it. Finally instead of coming out publicly, they made a small, barely readable text saying that MMS isnt available in the US till late Summer. Simple lawsuit...they clearly showing their crappy business practices by doing it.

Now, maybe they did or didnt do what is listed above...however, this is the reason why they are being sued...as i said before.

most people don't follow the industry events. they just go to the store and buy because they saw an ad or someone told them it was cool to buy something.

Oh, im not saying its not ridiculous...in fact ive stated this many times in the posts above...doesnt mean its not happening, nor does it change what Apple and ATT are being accused of.

This is why they are being sued...is it right? dont care. They need to feel the pressure and need to know the customers displeasure with they lack of this feature.

Any magazine ad or TV ad that falsely advertising something is completely open to law suits. If someone wants to take the time and money to enforce the laws on companies, thats up to them. It happens alot...its not to far of a stretch to believe that APPLE and or ATT have gone about this the wrong way.

This is america...we can sue for whatever we feel is unjustified. Clearly the courts think that what Apple and ATT is doing is NOT GOOD Business practices, which in turn is allowing the case to be tried. So they do feel that the evidence provided is enough to show that ATT and APPLE are at fault for the promotion of MMS service which is couldnt NOT deliver. Doesnt matter if APPLE is ready for MMS, the service doesnt work unless APPLE AND ATT are both ready. Apple knew that it wasnt going to be ready...but yet they still went on saying that it could...when they saw people complaining, they added the disclaimer, which is BARELY readable. Why would they do it like that? Simple, so they can say it was there all along and 99.9% of the people overlooked it since its written in such a small font.

Is there something different about an iPhone sending a picture message versus another phone? In other words, if all iPhone users who use AT&T had a different phone that could send picture messages would the network be affected in a different way?

No, AT&T are just being idiots. In the UK, and in most other places, iPhones have the MMS already.
