They misrepresented the MMS feature on their Iphone....doesnt matter if its Apples fault or ATT fault. Apple promoted as it was going to be released at with 3.0. People are pissed cause instead of stating that in the beginning, they went ahead and continue to promote it as a MMS capable without making sure ATT was ready for it. Finally instead of coming out publicly, they made a small, barely readable text saying that MMS isnt available in the US till late Summer. Simple lawsuit...they clearly showing their crappy business practices by doing it.

Now, maybe they did or didnt do what is listed above...however, this is the reason why they are being sued...as i said before.

Apple first announced that MMS would be an option for iPhones when it unveiled the iPhone 3.0 firmware. At June's WWDC event however, the company also warned that the feature would not be available from AT&T until late summer. That fact has been left out of both companies' marketing efforts, lawyers charge, resulting in "deception, fraud, false pretense, false promise, misrepresentation and unfair practices."

Apple basically presented this feature as an option (ie network dependent). I think Apple were honest. AT&T however..... ;)
