A lawyer is the last resort. He has his chargeback. He just has to wait and see if Apple bothers to decline it In time.
Fingers crossed that when they review the chargeback they see the notes in his files and say, “we have no chance to win” and they just let it go And he wins. We all win.

Has Apple declined anything, whether on paper, electronically, or in a stationary format?

They closed 2 investigations. By email and over the phone.

Did they give you the evidence of why they closed it? If you haven't already, you should ask for it in writing. If they give it, great. If not, still part of your evidence that they were unwilling to provide evidence you had possession.

No they said they cant disclose that information. This was over the phone and I asked more than once.

Can one side of a dispute close it unilaterally?

On their end yes. Taking Apple to court is going to pretty stressful so I dont want to do it unless it's a last Resort. Police still may be able to convince Apple or the bank that I didn't receive the laptops.

If Apple or the bank don't take the Police's word then they are straight up scamming me, I will go to small claims court or go to the papers. Or both.

Why don't you talk to one of those pro-bono lawyers about your dilemma? Losing 2500CAD is also stressful!

Called in Apple management just now to get an update to see if police have called. I was told everything the lady last week told me (the correct number for police to call, etc) was all wrong. I spent 30 mins on the phone with her explaining everything for nothing. Now there is a note on the file saying they cant disclose ANYTHING to me anymore and only Apple relations can speak to me about it. Apple relations is who told me they are done with the case last week.

Both calls were recorded. It is legal to do so in Alberta where I live.

Going to email a couple of local journalists. This is absolutely shocking behavior from Apple.

This is sounding more and more like the Apple version of Groundhog Day.

Try e-mailing Tim Cook again and also this time provide a link to this thread. For this is not good publicity for Apple and their supposedly ‘it just works’ philosophy. In this case, it just doesn’t.

I continue to advise your establishing which Canadian national newspaper carries a consumers' champion’s column – this case is prime material for such journalism. And it’s national: larger readership thus more shame and ‘embarrassment’ for a clearly failing aspect of Apple’s business practice. In the weekly national newspaper I read regularly the companies who are named and shamed in the column invariably respond immediately and do what they should have done (or not done) right at the beginning, long before the exasperated customer had recourse to contact the newspaper.

If you go to the local press and they are interested in the story, ask them if they would be prepared to run with the headline 'Apple steals customers $2,000' because you need to get them to make a headline that is attention grabbing.

Remember, only start looking into the legal route when you get official confirmation from Apple and VISA that the investigation into the theft of your macbooks is completed. The police investigation will only be interested in arresting the thief therefore there is no need to wait for their investigation to be over.

The reason you need to wait for the official confirmation from Apple and VISA ending their investigation because it is then you claim negligence/incompetence from both Apple and VISA for not bothering to contact the police about the evidence they have on the case. Yes it would be good if the police had called them but there is nothing stopping Apple and VISA calling the police once you gave them the crime number and the police contact details.

Subject to the above, once Apple and VISA give official confirmation their investigation is over is when you contact the police and ask them if they were able to contact Apple and VISA. If the police say they have not contacted either of them then you have justification to make a police complaint against the police officers tasked to your case because it they should have contacted Apple and VISA by now. Yes police are busy but investigating theft is their job and they have not done it.

To cover yourself for future action, get in contact with your landlord and ask them to keep a copy of the CCTV for that day because if the police happen to lose their copy of the CCTV, you do not have a leg to stand on because that CCTV footage proves the macbooks were not delivered and without it it just becomes your word against Apple's/Uber. Get a copy of the CCTV footage, do not rely on the police to keep a hold of their copy because if a police complaint is made, that CCTV footage could magically disappear.

Also you should contact the people at iphoneincanada.ca Maybe they'll put your story on their website so people do not order same day delivery from apple, and could get pressure on apple.

Seeing this has made it 10000% I will not be doing same day delivery.
Like seriously wtf why use UberEats drivers that is not acceptable at all.

What in the entire **** is Tim Cook doing.

All great advice. Thanks a lot bud.

Oh and when Apple and VISA end their investigation and give you their final result and it goes against you then you ring the police to find out if they had got in contact with Apple and VISA, make sure you record the conversation because if they say yes then it helps you against Apple and VISA but if they say no then it helps you with making a police complaint. There is still time for either of them to contact the police or for the police to contact them because the investigation by Apple and VISA is not over thus you do not want to jump the gun as the saying goes accusing either of them of negligence whilst the investigation is still ongoing.

Because remember, even if Apple make it official that their investigation has ended and they decide against you, VISA can still ignore what Apple tell them if VISA was to look at the police evidence. This is why you need to wait. If VISA end their investigation and say they are denying the charge back, that is when you ring the police to find out if Apple and VISA contacted them so they could see the evidence of the macbooks not being delivered.

Will have to now wait and see what Apple and VISA do because that will determine your next move.

"I'm sorry to hear about the trouble YOU have been causing lately"

I'm done going back and fourth with AI.

It would be easier to get ahold of the President than a human at Uber.

You should find the appropriate sub reddit on Reddit and post that reply. If reddit has an uber or scams subreddit you should post that uber response in there. People need to know that Uber is 100% using AI to respond to customer complaints and that your complaint response from Uber is proof of the company using AI to respond to customer complaints rather than a human being doing the responding. I bet it would not take long before the press picked up on it.

The reason for doing it would be to show people that Uber do not care about customer complaints. People need to know what Uber is doing. Exposing them might go to someway in helping you, you never know.

Will be hard because I don't have the CCTV footage, only the police do. Landlord told me head office will only supply it to the police.
That’s a red flag because the police will not retain that video indefinitely.

Was shocked to get a call from Uber today. Told her the whole story and while she sounded sympathetic she basically told me since the transaction was made through Apple Uber cant do anything. They wont look into the driver unless Apple asks them to or if police reach out through some online portal. Asked her how does she think Apple came to the conclusion that it was delivered and she said she thinks Apple didnt even speak to a human at Uber but just went off the fact it says delivered and then closed their investigation based on that. This isnt fact it's just what she thinks happened. Told her Im going to the news.

Not very interesting but Just thought Id update.

It would appear both Apple and Uber are sticking to company policy on dealing with theft and the police. Whilst I mentioned in one of my posts that both Apple and Uber could reach out to the police first, standard company policy when dealing with the police is that the police are to contact the companies involved telling them that there is a problem (have worked in business so I know how it works). From your recent posts it appears neither Apple or Uber have been contacted by any of the police officers who are looking into your case which could explain why Apple and Uber have been behaving the way the have (following company/policy procedure).

What you need to do now is ring the police and find out if the officers assigned to your case have contacted Apple and Uber and if they say they haven't then ask for an explanation because neither company can process your theft complaint until they get contacted by the police. If the officers make some excuses then you need to go down to the police station and make an official complaint. Granted the police will only be interested in catching the thief BUT there is also the element where a person is facing losing $2,500 if the police do not contact Apple and Uber.

BUT if the police have actually contacted Apple and Uber then both companies are lying to you and then it would be a case of going to the news.
