Because that was a feature of the product. Imagine buying a product and then the company disables the very feature that prompted you to buy that product.

It will only be for watches being sold and won't affect already sold watches.
 
Why not just disable the functionality on the software side until they can find another way.

Apple is trying things like this but will need the approval of ITC/US Customs that such a change, make them clear of the import and sales bans.
 
Or just pick up the phone this week and call this guy and settle it? How much could he possibly want? Apple is losing half a billion every week these things are off the market.
Problem is I don’t think it’s gonna be that simple because there is gonna be corporate bureaucracy involved. this was never going away with a phone call.
 
Could Apple return to selling the watches if the feature in question is disabled on the new watches? Of course they would have to expressly state, in all marketing materials, that this feature is no longer available on the new watches.
 
I am curious who is going around and downvoting every single comment that suggests Apple just pay the patent and move on. Apple Watch sales are something like half a billion per week. Apple can't possible prefer that to just paying up.
Ignore the downvotes, a downvote doesn't hold any value without a written explanation anyway. Maybe the downvote is from a person who doesn't like a user's avatar? We'll never know without more information.

It is clearly IP theft. Apple even hired some of Masimo's employees. This is not tolling. Masimo invented the technology.

What does not surprise me at all is the very poor reporting on this. Not one of these so-called "journalists" has bothered to read and explain the actual patent. They just keep copying/pasting the same. story. It would be good to know exactly what it is that Masimo invented. Is it the fundamental idea of using green LEDs or was it some way of processing the data? Apple only has a chance of a software fix if the patent is very narrow and specific.

Third party retailers can sell existing stock. Apple has halted sales online and in its brick and mortar locations.

No, because every Apple Watch has a serial number and even an IMEI number.

Apple could just make the software update happen on watches with serial numbers which are imported/sold after December 25th if allowed by the ITC.
