he is selling it as new resell....that is not accurate if it has been returned.

The screen was so bad in the bright light any reflection the screen had a major crease in it and two small dots that look like small bubbles right next to the trees it was very hard to photograph

I'm assuming you weren't able to leave him a bad review since the sale wasn't completed? that's a bummer, if so. He needs to have negative feedback for this deal. Sorry to see the next person will get this phone too :(

Looks like he lowered the price and sold it onto the next unsuspecting victim.

Looks like replacement front glass is abundantly available on places like Ebay. People buying his phone unknowingly voided their warranty.

Not sure how Swappa operate. So did he resell it or did the Swappa staff pull / halt the advert ?
The sale completed but i reported the guy I asked them to look up the recent dispute and look uo the IMEI numbers..they finally responded and said they were the same and would bring it up to the as seller on the sale page. No one has access to the sale page but buyer seller and staff. So don't know what will happen after that.

I hate to see someone go through what the OP did in his case. What a PITA to deal with dishonest people.

Why does Samsung have no obligation? The warranty is transferable. Now if the issue was that the seller tampered with the device, then yes Samsung has no obligation. But if it's a screen defect then they should replace it. It doesn't hurt to try. But a much faster method would be to simply bring it to your carrier, they would barely look at it before replacing it.

As for selling a brand new s8+ and selling it below cost, have you looked at Swappa? There are numerous listings of brand new and mint ones for sale below cost. Samsung has a tendency to drop in value once released. I see on average about $100 below cost, even less if you factor in not having to pay tax, shipping and activation fees.

The only thing that was a red flag was the negative feedback on the seller. I won't touch a negative feedback, or zero feedback for a sale on swappa.

We cannot say for sure that this is a defect covered by warranty. This might be damage caused by the seller. The original post did not mention that it came with all the papers, so we also cannot assume that the buyer will be able to provide proof of purchase. This is a swappa sale after all. If the seller legitimately purchased this phone wouldn't they have claimed their warranty instead of selling the unit at a loss?

I bought a note 7 from swappa brand new last year
Neither ATT or Samsung would help me.
I had to work it out with the seller.
Right after I bought it the started the recall.
I called Samsung many times and Att and went to the Att store.
I didn't buy it from either so neither would take it back or exchange it.

Highly doubtful any company would ship a product with that level of defect. More likely the seller sold a phone that has been repaired and botched the SAMOLED layer in the process. OP made the right decision to return it instead of wasting effort to correct the situation and thus covering up the seller's dishonesty.

Yep, just as highly unlikely as a phone would ship with an exploding battery, or reception issues due to antenna/hand placement, or screens with red tints, etc etc. /sarcasm

But I don't disagree with you in terms of uncovering the sellers dishonesty. Although in truth the seller didn't get penalized at all except maybe his outgoing shipping costs. He still resold the phone on Swappa, and I didn't hear mention that Paypal suspended him or anything. IMO it would be worth the effort to get a new warranty replacement and let the warrantee provider decide if it was a warranty issue, that way I'd get the phone for the swappa price but know I had a new one.

Oh absolutely, and my money is on the seller having done a poor job of replacing the screen.

Interesting, I wonder if that's changed. I've had many phones replaced by ATT, they never cared where I got them from, and the majority were not purchased through them. I even had ATT replace a Tmobile Note 5, they didn't care at all but the replacement was an ATT model (Tmobile denied the replacement because I didn't have an account with them). This isn't on the extended insurance policy, but a straight out warranty replacement. I've had one phone replaced at Verizon so far, they didn't care it was 2nd hand because it was still in the first year warranty.

edit: almost forgot, I also had a Note 7 replaced at Verizon that I purchased at Costco, they could care less. They then took that Note 7 back on the recall later on.

I went through hell with my note 7 no one would do anything.
I called Samsung like 10x and called Att and went to Att.
The store would do nothing for me.
He was like you didnt get it at Att why would Att exchange it.
And Samsung told me to go to Att also.
And said to call Samsung while I was at the store if I had a problem.
And Att store said calling Samsung won't help.
