I don't find the game appealing much less the video, but first amendment rights are first amendment rights.
So you can use company logos as a gang signs?You can show trademarked device designs as detonators?I think NOT .If so then Rockstar Games would have used an exact copy of an iPhone ingame,not a lame ripoff.You know the name of this phone?Its called iFruit. You would think they would exercise their rights and just call it an iPhone and use an exact design ingame

Well apparently in the case of the video YouTube is allowing it.

As far as other types of cases one would have to consult a qualified attorney to find out if said usage is legal.

No it wasn't hyperbole actually, I want to know what you think Samsung should do? And YouTube will be taking the videos down again if Samsung requests it I would think. It won't go to court because plenty of other videos are taken down daily due to copyright breaches, you may as well claim any video can have anyone's music in them.

The point being to take care of their customers. Ask their millions of customers if they are happy with the way this was handled and if they are satisfied with Samsung. The microcosm on MR is a mixed bag.

I wasn't talking about newscasts, but YouTube would lose a court case, it would have to basically defend breaching copyright. If it's instructed it will take the videos down.
And Samsung are staffing some kiosks in airports to help those customers being caught by the flight ban:

You seem to have a fair amount of certainty youtube would lose a court case. Can you explain your prediction why Youtube would lose a court case here in the US? I would think Youtube already considered that in its decision.

That doesn't prove anything legally. I have seen copyrighted movies continue to exist on YouTube
You can't know what happened behind the scenes with the definition of legal. This is an opinion only not a fact.

Not after they were taken off, you didn't.
Videos from particular channels were removed and they reappeared on some other channels and these very same videos weren't removed .I wouldn't take any removal from YouTube seriousky

I have played this game and have also played with mods in this game .There are several analogies which are virtually obvious with their real life counterparts for gadgets , cars and even food but the point is they clearly avoided naming and designing it to the T which they wouldn't if it was a parody and immune from winning cases

They have even used real life personalities to reflect the OS.Michael is a snob and uses iPhone.Trevor is crazy and he uses Windows Phone and Franklin is involved in illegal hood activities and he uses Android

Well they are not allowed to use a brand without permission on an official release are they? They use association with enough similarity for people to laugh that it's supposed to be an iPhone.

Regarding mods they have less control as these are put in by players during online play. It's an absolute mine field tracking down individuals and blocking mods. They can remove them but there is nothing to stop them being put up again and again. The same applies with YouTube. After Formula 1 races there is a window of time where FOM have videos containing race clips removed from YouTube, but this lasts about 24 hours. It's impossible to continue removing videos when the medium is used by millions, if not billions of people. Samsung and their like are huge companies with lots of power, but even they can't employ round the clock surveillance of what is being posted to YouTube. It's a no win situation for them and with time the vids will be less of a story.

The fact is the video is up. It's also a video of the mod, which could be the deciding factor. Samsung will probably lose this in court if they persue this along with more negative publicity and embarrassment than already facing.

So lets take an example.Supposing there is a gang ingame with Apple logo as an gang sign and using an exact iPhone design and the are shown to be doing terrorist activities in game using the iPhones as mobile detonators.According to you Apple can do nothing to stop this right?

Probably can't stop the news outlets from showing a video of the mod or Youtube from showing a video of the mod. Although this is a loaded question the same basic thoughts apply across the board. Nice hypotheticals.

We all know they don't use brands in GTA. They are not likely to release a game where they can get sued by Apple or Samsung when used in the official release.
Exactly.The fact that there is potential to lose a suit is what results in these fake knockoffs being used ingame.Hence I believe Samsung will win this one

Indeed. The Simpsons, Spider-Man, Ferrari, to name a few have all been used in GTA mods. There is nothing these companies can do to stop it, and Rockstar have the funds to get cases laughed out of court these days. It's not their problem if the games are modified on PC versions.
