So I guess all those people who are taking Apple and AT&T to court for misleading/false claims about MMS are just gonna have a stronger case now?

Unfortunately. People who are too lazy to work for their money leeching it from corporations who are too lazy to defend themselves against frivolous lawsuits.

I'm ashamed for a lot of people in this country.

Ummm.... oh nvm, that would be stating the obvious.

I was saying that I actually would have preferred it if they came out and said it was delayed until late fall instead of them releasing it three days into fall. At least that way it would seem like they still have a lot of work to do, instead of a little "Ha Ha, we'll release it three days late and they won't do anything".

And for everyone whining about this being another MMS thread, cause while it's actualy a poor AT&T customer service thread, who cares if it is an MMS thread? No one forced you to read it, or evenmore go through the trouble of replying. Get over yourselves, people whine about far more petty things on here... I've seen at least as many threads on 3.1, cracks in plastic housing and light leaks. It's just a forum, it's not like I'm knocking on your door at 7am on Saturday to talk about MMS.

I called 611 on AT&T and asked about the release Date. The CSR didn't even know about the 25th as the release date. I asked about AT&T being in breach of contract by saying "Late Summer" and was told that if I didn't like it that I could cancel my account pay the ETF and be done with them, and that he didn't care either way.
AT&T is just another Large Company out to screw anyone they can and get away with it

Well, I've said that before, and I've done that before. And yet, here I am...

Well I didn't mean MR. I meant AT&T. And I'm really just being facetious. I've tried several times to get away from the iPhone and failed. I know it's not happening anytime soon.

WHOA WHOA WHOA WHOA WHOA WHOA WHOA WHOA......

.....the iPhone can't do MMS?

I'm raising the flag.

I almost certainly would have seen a thread about it somewhere around here.

You ain't gotta lie to kick it...

Who cares what AT&T said? People should just stop whining about it, and get a life. No one is going to get any money out of it. The fact that people are trying to sue over a promise is absolutely ridiculous.

Paying costumers expecting promised services. How dare they. Contract responsibility goes both ways.

AT&T and Apple could have simply said it was delayed and promised a when date soon, but really what happened if they did that people would have flipped out still and they proably wanted to give a firm date.

I thought it came out last night when I updated the carrier file swapped sim cards than boom MMS on the 3GS.. No Jailbreak needed.

lol, if it was 100% legit I'm pretty sure it would have came through iTunes.

Enough with the MMS threads. Really, it's getting ****ing old.

hmmmmmmm i would highly recommend that if the MMS threads annoy you... that you just don't open them.... ya know: ignore them! read a thread on a subject you care about! :D

There was nothing in your contract with AT&T that promised MMS.

Actually there is and promising a feature would be included by a cetrain time frame where people would be making a purchase on the asumption it would be there by that time frame is a contract failure in most states.

The fact remains, AT&T did say it would be avaible late summer and they just made offical annoucement they would miss it. Since summer ends on the 21 and fall begins.

I sincerely hope nobody actually bought an iPhone solely for it's MMS capabilities...

I honestly didn't care that much about the MMS fiasco until this date came out. I actually think I would have preferred it if they came out and said it had been delayed until late Fall, well actually I would have preferred if no timeframe came out at all.

As we all know, Summer ends on September 22nd ( well, we all should know ) and they promised "Late Summer", I just wonder ... What kind of thing can they do in those three extra days to justify breaking a promise? Just seems like bad business and a slap in the face to me for 3 extra days.

Just my thoughts though, what do you guys think?

Only reason I can think of it delaying it those 3 days is to move what they know will be a sudden spike in the system to away from the business week. It shoves all the spike in data of people sending MMS text to the off peak time of the weekend. AT&T knows after 2-3 days of having MMS on the iPhone people will grow bored with it and it will fall back to normal usage.

It falling on a Tuesday would be very problematic for the system because Tues-Thursday are more than likely the heavies data days on the system so AT&T does not want to risk thing messing businesses that pay a hell of a lot more money than iPhone users.

Perhaps he's not stupid, but insinuating that he would rather MMS be delayed further just to meet some imaginary deadline is stupid, imo.

If you took every statement I made literally, you my friend apparently do not understand the brilliance of the literary use of hyperbole. I was meerly pointing out the poor business decisions of AT&T and how it can make iPhone users feel.

For those saying AT&T didn't have any contractual obligations to make MMS available before the end of summer you're mostly correct apart from those of us that got it put in our contract. I'm actually glad it won't be out until the 25th, because since it's not out on or before the 22nd I get 6 months of free unlimited messaging. So as I've said, there's no whining coming from here, just awe of AT&Ts poor business decisions.
