If you're so offended, tell AT&T no thanks. Really. Just say you don't want MMS and ask them to take it off your account. They took too long in implementing it and it's now their loss.

Who cares what AT&T said? People should just stop whining about it, and get a life. No one is going to get any money out of it. The fact that people are trying to sue over a promise is absolutely ridiculous.

LOL, have you never heard of "contract law?" When people sue over a broken contract, that is exactly what they are suing over... A PROMISE. A contract is nothing but a promise to do something in return for a promise to do something. When someone fails to live up to their PROMISE, they get sued. Nothing new here.

What is a feature that is available and most popular in phones? text messages. Why would BlackBerry really care about their web browsing compared to MMS and messaging features? Isn't that what most phones are set up to be? Unless you are taking this device as an MP3 player internet device. With a phone tacked on. Which pretty much invalidates your previous argument. A lot of the ads I saw for the iPhone include the internet browsing, music and the phone. Which is why I say you can't judge a feature's worth based on how much you would use it. Especially considering you saying it's sad that people would buy a phone for just MMS. It's the entire package and if you took other parts away you would probably complain. Also MMS was advertised through Appples conference as an iPhone feature. And they jsut happened to say late summer at the show. Which means FALSE ADVERTISEMENT FOR A SUBSCRIPTION DEVICE.

I'm not predicting anything. I'm just saying, I can see why someone may want to sue over this. AT&T did break a promise. They made an explicit promise that MMS would be available by "late summer." Furthermore, many people bought iPhones under an (at least implied) promise that MMS would be available with iPhone OS 3.0. So I can understand why many of those people feel shafted. AT&T's lack of transparency has only exacerbated things. I myself am a lawyer. Would I personally take on somebody's class action and sue AT&T on their behalf? Probably not. But I can understand why someone would want to pursue litigation against them, under these circumstances.
 
The first definition that came up for me from Mac OS X's built-in dictionary was: "doing something or taking place after the expected, proper, or usual time". So, looks like they're right on the money then! :D

The AT&T dictionary stated, "doing something whenever we feel like it." :D

So now it all makes sense ... I think we talked about this before .aggie ... You were right.

AT&T, bite the bullet. We've already exposed your networks' weaknesses. It's abundantly clear that customer enthusiasm on September 25 will cripple your network. Tell you what, by October 25 the data demand will settle a fraction above where it's been since 3G was released.

Instead of sending contractors to a thousand towers every occassion that you provide a new iPhone or feature why not take a premeditated approach? Worst thing that will happen is customer satisfaction; unless that's frightening/unfamiliar territory for you.

I renewed my contract around the time they announced "Late Summer" and I had them write that I would have MMS by September 22nd into my contract or I get 6 months of free unlimited messaging. So in my case I do have it in my contract, and I'm actually glad they're breaking it, haha.
