In macOS Sierra, in the extensions settings of Safari I get warned that Adguard (2.3.9) is able to read and transfer all pages I visit and all infos I submit. Is that because of the "fallback"-option to the old api
Not only because of the fallback. Adguard registers a bunch of "content scripts":

Partly these content scripts are used for ad blocking, the other part is necessary for the "manual element blocking" feature.
Can it still transfer/read data even if I'm using the new api?
Yes, it can do it through the content scripts. In fact any extension can do it, so you should be really careful installing any browser extension.
I guess you should decide it on your own.
What for us, we are trying to be as open and transparent as possible:
1. Adguard browser extension is open source.
2. We provide a
detailed privacy policy.
Also all Safari extensions are reviewed by Apple staff very thoroughly (otherwise I don't understand why it sometimes takes up to 2 months
).
