The reality is would John Lewis actually know you've connected the item? Probably not - especially if factory reset (or in the case of AirPods, removed from your iCloud account).
Also, not that I'm advocating it, but JL would have no choice on accepting a return for a seemingly faulty item, and would have to issue a refund.
In most cases with open box returns anyway, they'll probably just be shipped back to Apple for refurbishment.

Well, that information wasn't correct. And AO.com don't have any choice over receiving open box returns either (for smaller electronic items - installed items like white goods would be a bit different). They may not like it, but you're fully entitled to open and inspect the item, and return (at your cost) if you're not happy with it. The law is quite clear.this is what they told me when I spoke to them. Ao.com also don’t accept open box returns.
