No don’t replace them yet - this is a known issue many of us are experiencing.

I’ve taken them to an Apple Store (after multiple testing over the phone with Apple Support) with video evidence of the inaccuracies of battery levels & they advised to wait for the next firmware update.

There are at least another two threads on this...
They are reeaaally taking their time with that firmware update fix, because my Pro 2 have a very similar issue to what OP posted about in 2020.
But, was what you experienced fixed at least?

Hopefully you get a fix soon, but if the readings are misleading, then you shouldn’t run out of juice

They are bought from a Premium Apple Reseller and that's why I am a little bit concerned - in case they insist on repairing them instead of replacing them. They are not even a month old.
To your knowledge, does Apple has something to do with it? Should I call Apple Support directly so I will make this easier for replacement?
You cannot repair AirPods. It’s not possible. Only Apple can make genuine refurbished ear pieces (they sell refurbished AirPods on their site when they have stock).

Always contact Apple when dealing with warranty repairs. However, without AppleCare, it will be an expensive visit unless the battery is shown to be failing. Which is what tends to cause these problems where one piece’s battery life varies considerably from the other.
